RE: LSA Document #17-283, which adds 856 IAC 1-43 concerning ephedrine and pseudoephedrine

These rules will establish requirements concerning the sale of products containing ephedrine or pseudoephedrine by pharmacists. The rule will establish requirements regarding "conversion resistant" and "extraction resistant" products containing ephedrine or pseudoephedrine.

On behalf of the Indiana Professional Licensing Agency and the Indiana Board of Pharmacy, I am submitting this notice to the Publisher of the Indiana Register and Indiana Administrative Code in compliance with IC 4-22-2-25, which requires that a notice be sent to the Publisher if a rule will not be approved or deemed approved by the Governor within one year of publication of the Notice of Intent to Adopt a Rule. This notice is submitted to the Publisher before the two hundred fiftieth day following the publication of the Notice of Intent to Adopt a Rule.

The Notice of Intent to Adopt a Rule was published in the Indiana Register on June 14, 2017 (DIN: 20170614-IR-856170283NIA).

Due to multiple rules currently in development by the Board, the Board anticipates that final approval by the Governor's office will not occur within one year of publication of the Notice of Intent to Adopt a Rule. It is expected that the rule will be approved or deemed approved by the Governor by February 13, 2019.

This notice is being submitted in a timely manner. February 13, 2018, is the two hundred forty-fourth day after publication of the Notice of Intent to Adopt a Rule.
