On behalf of the Indiana Gaming Commission (Commission), I am submitting this notice in compliance with IC 4-22-2-25. Pursuant to IC 4-33-24-13(a), the Commission is adopting rules to regulate paid fantasy sports games in the state of Indiana.

On May 10, 2017, the Commission posted its Notice of Intent to Adopt a Rule concerning paid fantasy sports games (DIN: 20170510-IR-068170224NIA). On September 8, 2017, the State Budget Agency provided the Commission with approval to post the rule, which the Commission posted on September 27, 2017 (DIN: 20170927-IR-068170224PRA). The Commission held its public hearing on the rule on October 23, 2017. Finally, the rule was presented to our commissioners for approval at the Commission's November 16, 2017, business meeting. The Commission approved the rule (Commission Resolution 2017-217) and it was subsequently submitted to the Office of the Indiana Attorney General (OIAG) on November 27, 2017, for review and approval. The OIAG has until January 11, 2018, to complete its review. If approved by the OIAG, the Governor would have an additional 30 days to review and approve the rule.

Thus, the Commission submits this notice out of an abundance of caution should the OIAG or Governor determine further Commission action is required with respect to the rule. If further Commission action is required, the earliest date the Commission could approve that action would be at the next scheduled quarterly business meeting, which is tentatively set for March 8, 2018. Additional business meeting dates are tentatively scheduled for June 7, 2018, September 13, 2018, and December 6, 2018.

The Commission expects the rule will be approved or deemed approved by the Governor or withdrawn under IC 4-22-2-41 by, at the latest, November 1, 2018.

The 250th day after publication of the Notice of Intent to Adopt a Rule is January 15, 2018. This notice is submitted in a timely manner.
