TITLE 405 OFFICE OF THE SECRETARY OF FAMILY AND SOCIAL SERVICES
Notice of Intent to Adopt a Rule

Under
IC 4-22-2-23, the Office of the Secretary of Family and Social Services intends to adopt a rule concerning the following:
OVERVIEW: Amends
405 IAC 10-2-1,
405 IAC 10-10-5, and
405 IAC 10-10-6 to align HIP benefit periods with the calendar year and make related changes to rollover and contribution calculations for members with benefit periods of less than 12 months. Adds
405 IAC 10-3-4 to allow HIP maternity enrollment on the first of the month after eligibility determination. Amends
405 IAC 10-4-5 to allow transitional medical assistance requirements to be waived for individuals below 138% of FPL (those otherwise eligible for HIP). Amends
405 IAC 10-4-6 to allow HIP maternity members to remain in HIP through the postpartum period, and it also defines the HIP maternity period to begin the first day of the month following pregnancy determination. Amends
405 IAC 10-7-3, which is expected to result in the addition of limited chiropractic services to the HIP Plus alternative benefit plan. Amends
405 IAC 10-10-3 to consolidate the contribution schedule into five income tiers rather than individualized amounts. Adds
405 IAC 10-10-15 to authorize tobacco user contributions that are 50% higher than for non-tobacco users. Amends
405 IAC 10-11 to end the HIP Link program. Current program participants are expected to transition to HIP Plus. Effective 30 days after filing with the
Publisher. Statutory authority:

IC 5-28-17-6, specifically
IC 5-28-17-6(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
