On behalf of the Indiana Family and Social Services Administration (FSSA), I am submitting this notice in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process for new rules not later than 60 days after the effective date of the statutes that authorize the rule, unless a notice is filed with the Publisher that includes the reasons why rulemaking began more than 60 days after the effective date.

The statutory authority for rulemaking that allows FSSA to add to or amend 405 IAC 10 is found in IC 12-15-44.5-9. FSSA did not begin the rulemaking process for the new proposed rule sections within 60 days of the authorizing statutes because the proposed rule implements program changes.

FSSA initiated the rulemaking process by publishing its Notice of Intent to Adopt a Rule in the Indiana Register on November 8, 2017 (DIN: 20171108-IR-405170484NIA).
