IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Estimated Number of Small Businesses Subject to this Rule:
The Indiana Criminal Justice Institute (ICJI) estimates that 50 small businesses will be impacted by this rule. The rule adds a certification process for ignition interlock installers and service centers required under IC 9-30-8. ICJI estimates, based on current lists of businesses, that a minimum of 50 small businesses statewide will be impacted by the rule.

Estimated Average Annual Administrative Costs that Small Businesses Will Incur:
ICJI estimates that 50 small businesses affected by the certification process will incur some moderate initial costs, and some biannual costs. These costs are anticipated to be born or reimbursed by the ignition interlock manufacturers. The small businesses in conjunction with the ignition interlock manufacturers will be required to apply for, and receive, the certification and renewal.

Estimated Total Annual Economic Impact of Small Businesses:
ICJI estimates that there will be an approximate initial $1,000 total fiscal impact on small businesses as a result of compliance with this rule. ICJI further estimates there will be an estimated $400 biannual total fiscal impact to small businesses as a result of compliance with this rule. Again ICJI anticipates a majority of these costs may be paid or reimbursed by the ignition interlock manufacturers.

Supporting Data, Studies, and Analyses:
ICJI compiled a complete list of known ignition interlock installers and conducted multiple meetings with ignition interlock manufacturers on the topic and reviewed costs and rules of multiple other similarly situated state programs.

Regulatory Flexibility Analysis of Alternative Methods:
ICJI has conducted multiple hearings with the ignition interlock community, manufacturers, and representatives from the ignition interlock manufacturers association in anticipation of the implementation of this rule. Each manufacturer with approved devices in Indiana have all committed to working with the installers and service centers to bear the costs of this rule.

Explanation of Preliminary Determination:
ICJI did not make a determination as to whether or not the rule was necessary as the promulgation of the rule by the ICJI is required under IC 9-30-8-7.
