TITLE 312 NATURAL RESOURCES COMMISSION

DIGEST

Temporarily designates the boundaries of the bovine tuberculosis surveillance zone. Temporarily allows a hunter who takes a deer in the designated bovine tuberculosis surveillance zone and submits the deer to the department for the testing of bovine tuberculosis to enter a drawing to take an additional antlered deer between October 1, 2018, and January 6, 2019. Temporarily prohibits the intentional feeding of deer in designated portions of Franklin and Fayette counties. Effective October 1, 2017.


SECTION 1. (a) This SECTION is supplemental to 312 IAC 9-3-2.

(b) The "bovine tuberculosis surveillance zone" is defined as follows:
(1) the portion of Fayette County south of State Road 44 and west of State Road 1; and
(2) the portion of Franklin County bounded by the following:
(A) From the northwest corner of Franklin County east to Brookville Lake.
(B) The western half of Brookville Lake south to the Tailwaters of Brookville Lake.
(C) South along the Tailwaters of Brookville Lake to State Road 101.
(D) South along State Road 101 to State Road 1/Main Street.
(E) South along State Road 1/Main Street to 6th Street.
(F) West along 6th Street to St. Mary's Road.
(G) West along St. Mary's Road to Pumphouse Road.
(H) West along Pumphouse Road to Pipe Creek Road.
(I) West along Pipe Creek Road to Hickory Road.
(J) West along Hickory Road to State Road 229.
(K) North along State Road 229 to Beacon Road.
(L) West along Beacon Road to Bullfork Road and continuing onto Harvey Branch Road.
(M) South along Harvey Branch Road to Beacon Road/Harvey Branch Road.
(N) South and west along Beacon Road/Harvey Branch Road to Rail Fence Road.
(O) West along Rail Fence Road to Hilltop Road.
(P) West along Hilltop Road to Bullfork Road.
(Q) South along Bullfork Road and continuing onto North Hamburg Road.
(R) West along North Hamburg Road to West Hamburg Road.
(S) West along West Hamburg Road to the Franklin/Decatur County boundary.
(T) North along the Franklin/Decatur County boundary to the northwest corner of Franklin County.

(c) Notwithstanding 312 IAC 9-3-2(n), an individual who:
(1) takes a deer in the bovine tuberculosis surveillance zone; and
(2) submits the deer carcass to the department or to the department's authorized designee for the testing of bovine tuberculosis within:
(A) twelve (12) hours of taking the deer; and
(B) before the deer carcass is removed from Indiana;
will be entered into a drawing to take an additional antlered deer from October 1, 2018, through January 6, 2019.

(d) The department will conduct a drawing in January 2018, as follows:
(1) The drawing described in this SECTION shall be conducted on a random basis by the department to authorize the take of not more than ten (10) additional antlered deer.
(2) No hunter entered in the draw will be authorized to take more than one (1) additional antlered deer.
(3) A hunter may have an unlimited number of entries in the drawing based upon the number of deer taken and submitted for bovine tuberculosis testing in accordance with 312 IAC 9 and this document.
(4) The number of entries each hunter will have in the draw will be based upon the deer submitted by the hunter for testing, according to the following, which represents the deer's proportional value in disease surveillance:
(A) Buck 2.5 years of age or older = 10 entries
(B) Doe 2.5 years of age or older = 3 entries
(C) Buck or doe 1.5 years of age = 1 entry
(D) Buck or doe fawn = 0 entries

(e) A hunter may use the additional antlered deer authorization issued in accordance with this document only from October 1, 2018, through January 6, 2019.

(f) A hunter using the additional antlered deer authorization issued in accordance with this document shall comply with 312 IAC 9-3-2 through 312 IAC 9-3-4.

(g) An individual must not bait (as defined in 312 IAC 9-3-2(u)(1)(A) and (B) [312 IAC 9-3-2(u)(1)(B)]) or knowingly or intentionally feed or attempt to congregate deer or any other wild mammal for any purpose in the bovine tuberculosis surveillance zone as defined in SECTION 1 of this document [this SECTION]. The use of salt and mineral licks and normal agricultural practices, including the use of food plots, are not prohibited.

SECTION 2. This document expires on September 30, 2018.
