Notice of Increases in Reimbursement for Select Services in the
Community Integration and Habilitation and Family Supports Waivers


In accordance with public notice requirements established at 42 CFR 447.205, the Indiana Family and Social Services Administration (FSSA) Office of Medicaid Policy and Planning (OMPP) and the Division of Disability and Rehabilitative Services (DDRS) intends to submit proposed amendments to the Community Integration and Habilitation (CIH) waiver and the Family Supports Waiver (FSW), to the Centers for Medicare and Medicaid Services (CMS) for consideration.

Both waivers provide Medicaid Home and Community-Based Services (HCBS) to participants in a range of community settings as an alternative to care in an intermediate care facility for individuals with intellectual disabilities (ICF/IID) or related conditions. The waivers serve individuals with intellectual disabilities, autism spectrum disorder, or developmental disabilities, and who have substantial functional limitations, as defined under the paragraph for "Persons with related conditions" in 42 CFR 435.1010. Participants may choose to live in their own home, family home, or community setting appropriate for their needs.

The proposed amendments to CIH and FSW include provider rate increases as well as updates to the waiver-specific statewide transition plan portion of the amendment. The amendments will be effective December 1, 2017, or earlier contingent upon CMS approval. The state has requested an expedited review, which may result in an earlier effective date, contingent upon CMS approval.

These changes are being proposed pursuant to legislative mandate by Indiana House Enrolled Act 1001, (https://iga.in.gov/legislative/2017/bills/house/1001), which mandates a 5% rate increase for the following services:

The CIH and FSW amendments contain waiver-specific statewide transition plans for compliance with federal HCBS settings regulations. Both amendments report additional progress toward implementation of the plan including the current status of site-specific assessments. The CIH and FSW amendments will be available for review and comment on the Division of Disability and Rehabilitative Services Draft Policies for Public Comment webpage (http://www.in.gov/fssa/ddrs/4205.htm) on or before July 12, 2017.
