Pursuant to IC 4-22-2-25, the Fire Prevention and Building Safety Commission submits this notice to the Publisher of the Indiana Register and Indiana Administrative Code that 675 IAC 19-4, the 2010 Indiana Energy Conservation Code, cannot be adopted within one year after the publication of the Notice of Intent to Adopt a Rule.

Due to a request for separate readoption of the 2010 Energy Conservation Code from the readoption rule, filed pursuant to IC 4-22-2.5-4, the 2010 Energy Conservation Code readoption was required to go through the full rulemaking process outlined in IC 4-22-2. As readoption through the full rulemaking process was not anticipated, the agency has determined that this rule cannot be adopted within one year after the publication of the Notice of Intent to Adopt a Rule.

The readoption of the 2010 Energy Conservation Code is expected to be completed by November 7, 2017, and approved or deemed approved by the Governor by December 1, 2017.

This notice is to be submitted to the Publisher before the two hundred fiftieth day following the publication of the Notice of Intent to Adopt a Rule. The Notice of Intent to Adopt a Rule was published on August 10, 2016 (DIN: 20160810-IR-675160329RNA). The two hundred fiftieth day is April 17, 2017, therefore this notice has been timely submitted.
