Under IC 4-22-2-24, notice is hereby given that on April 11, 2017, at 9:45 a.m., at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100, Indianapolis, Indiana, the Indiana State Board of Animal Health (BOAH) will hold a public hearing on a proposed rule that amends BOAH's rule governing swine enteric coronavirus disease (SECD). The purpose of the proposed rule is to align BOAH's rule with the amended federal order that was issued by the United States Department of Agriculture – Animal and Plant Health Inspection Service (USDA-APHIS) on January 4, 2016. The proposed rule amends 345 IAC 3-6-1 to remove the definition of a "herd management plan". The proposed rule also repeals 345 IAC 3-6-3 to remove the state's requirement for development and submission of a herd management plan no later than forty-five (45) days after the state veterinarian receives notice of a positive case.
The proposed rule does not impose costs beyond what is expressly required by state and federal law. Therefore, the proposed rule does not impose costs on a regulated entity that would require a justification statement under IC 4-22-2-24(d)(3).
Copies of these rules are now on file at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100 and Legislative Services Agency, Indiana Government Center North, 100 North Senate Avenue, Room N201, Indianapolis, Indiana and are open for public inspection.
