Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on October 4, 2016, at 9:50 a.m., at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100, Indianapolis, Indiana, the Indiana State Board of Animal Health (BOAH) will hold a public hearing on a proposed rule governing dairy products inspection. The primary purpose of the changes is to conform BOAH rules to the 2015 Grade A Pasteurized Milk Ordinance (PMO). The proposed rule updates the current incorporation by reference of the 2013 PMO to the 2015 revision and certain Food and Drug Administration (FDA) food standards from April 1, 2014, to April 1, 2016. The proposed rule also aligns standards for manufacturing grade milk plants with 9 CFR 117, Good Manufacturing Practice, Hazard Analysis, and Risk-Based Preventive Controls for Human Food, which was published on September 17, 2015.
The proposed rule does not impose costs beyond what is expressly required by state and federal law. Therefore, the proposed rule does not impose costs on a regulated entity that would require a justification statement under IC 4-22-2-24(d)(3).
Copies of these rules are now on file at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100 and Legislative Services Agency, Indiana Government Center North, 100 North Senate Avenue, Room N201, Indianapolis, Indiana and are open for public inspection.
