TITLE 327 WATER POLLUTION CONTROL DIVISION

Temporarily adds provisions for the completion of a reporting form for above ground storage tanks in accordance with IC 13-18-5.5-10(d). Statutory authority: IC 13-14-8-1. Effective October 15, 2015.

SECTION 1. (a) The definitions in IC 13-18-5.5 apply throughout this document.

(b) Unless exempt under IC 13-18-5.5-11 or subsection (d) of this document, the owner or operator of an above ground storage tank (AST) located in a critical zone of concern shall submit a completed reporting form to the department before January 1, 2016, on a form found at: http://www.in.gov/idem/cleanwater/2369.htm and that includes the following information for each AST:

(1) The location of each AST, including the following:

(A) Company name.

(B) Full street address.

(C) Global Positioning System (GPS) coordinates.

(2) Materials stored in each AST.

(3) The maximum capacity of each AST in gallons.

(4) Contact information, including the following:

(A) For the AST owner, the following:

(i) Name.

(ii) Mailing address.

(iii) Phone number.

(iv) Electronic mail address.

(B) For the emergency contact, the following:

(i) Name.

(ii) Mailing address.

(iii) Twenty-four (24) hour contact phone number.

(iv) Electronic mail address.

(c) After submitting a report under subsection (b), the owner or operator of an AST shall submit to the department a supplemental report concerning the AST at any time there is a change to any of the following:

(1) The location of the AST.

(2) The classification of the materials stored in the AST.

(3) The capacity of the AST.

(4) The name or contact information of the person who may be contacted for information about the AST.

(d) The owner or operator is not required to report to the department concerning the AST if the existence of the AST has been reported to the department or another agency of the state in accordance with a state law or administrative rule.

SECTION 2. A variance request from the requirements of this document shall be made in accordance with IC 13-14-8-8.
