Under IC 4-22-2-24, notice is hereby given that on October 8, 2015, at 9:40 a.m., at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100, Indianapolis, Indiana, the Indiana State Board of Animal Health will hold a public hearing on a proposed rule that amends 345 IAC 2-6 governing cattle brucellosis control and eradication. The proposed rule conforms the Indiana State Board of Animal Health's rules to the recently amended United States Department of Agriculture - Animal and Plant Health Inspection Service (USDA-APHIS) requirements at 9 CFR Part 78.1 governing the testing and certification for brucellosis class-free states and certified brucellosis-free herds. The proposed rule aligns certain definitions with the federal regulations, changes the age of cattle to be included in a herd blood test for purposes of establishing and maintaining a certified brucellosis-free herd, and authorizes the state veterinarian to approve alternate brucellosis milk testing protocols in order to certify and maintain a dairy herd as brucellosis-free.
The proposed rule does not impose costs beyond what is expressly required by state and federal law. Therefore, the proposed rule does not impose costs on a regulated entity that would require a justification statement under IC 4-22-2-24(d)(3).
Copies of these rules are now on file at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100 and Legislative Services Agency, Indiana Government Center North, 100 North Senate Avenue, Room N201, Indianapolis, Indiana and are open for public inspection.
