TITLE 312 NATURAL RESOURCES COMMISSION

Temporarily amends 312 IAC 9-10-9 to remove the requirement for continuing education for a wild animal rehabilitation permit holder that had a permit for more than 10 years. Effective December 1, 2014.

SECTION 1. (a) This SECTION supersedes 312 IAC 9-10-9(d).

(b) Before a permit may be issued, the applicant must correctly answer at least eighty percent (80%) of the questions on a written examination supervised and administered by the department covering basic biology, care of wild animals, and the laws relating to wild animal rehabilitation.

(1) An individual who fails to correctly answer at least eighty percent (80%) of the questions on the examination may retake the examination not more than two (2) additional times within ninety (90) days, but not again within one hundred eighty (180) days after the third failure.

(2) Exempted from this subsection is an individual who has had a permit under this section for ten (10) years and taken in at least twelve (12) wild animals each year for rehabilitation.

SECTION 2. (a) This SECTION supersedes 312 IAC 9-10-9(e).

(c) A permit holder must, every three (3) years after being issued a permit, either:

(1) satisfy the same requirements as are set forth in SECTION 1 of this document;

(2) complete eight (8) hours of continuing education as approved by the division including courses that will be sponsored by the department, National Wildlife Rehabilitator's Association, or International Wildlife Rehabilitation Council. A permit holder who is exempt under SECTION 1(b)(2) of this document is also exempt from the requirements under this SECTION of this document.

SECTION 3. This document takes effect December 1, 2014.

SECTION 4. This document expires on November 30, 2015.
