SOURCE SPECIFIC PARTICULATE MATTER EMISSION LIMITATIONS


PURPOSE OF NOTICE
The Indiana Department of Environmental Management (IDEM) has developed draft rule language for amendments to 326 IAC 6.5 and 326 IAC 6.8 concerning source specific particulate matter emission limitations. By this notice, IDEM is soliciting public comment on the draft rule language. IDEM seeks comment on the affected citations listed and any other provisions of Title 326 that may be affected by this rulemaking.

SUBJECT MATTER AND BASIC PURPOSE OF RULEMAKING
Basic Purpose and Background
The purpose of this rulemaking is to update the source specific information found within Indiana's rules concerning particulate matter emission limitations at 326 IAC 6.5 and 326 IAC 6.8. Source categories subject to the particulate matter emission limitations include fuel combustion steam generators, asphalt concrete plants, grain elevators, foundries, and mineral aggregate operations. The rules containing these limitations have been approved into Indiana's state implementation plan (SIP) as permanent and enforceable provisions in order to address attainment of particulate matter air quality standards and must be maintained for continued attainment unless replaced with a comparable reduction. The department has been notified by several regulated sources that information contained within these rules may have become inaccurate or obsolete. This rulemaking will ensure that the information in 326 IAC 6.5 and 326 IAC 6.8 is current and correct. These changes will be submitted to the United States Environmental Protection Agency (U.S. EPA) for approval into Indiana's SIP.
There are two sources located in Lake County with proposed changes that are more than an administrative update: Jupiter Aluminum at 326 IAC 6.8-2-18 and Huhtamaki Foodservice at 326 IAC 6.8-2-34. Jupiter Aluminum has requested that the references to the aluminum reverberatory furnaces 3, 4, and 5 be removed as these furnaces no longer exist. The reductions in allowed emissions from these furnaces will be used to compensate for an increase in the PM10 limits to furnaces 2 and 6. IDEM in coordination with U.S. EPA, has modeled the proposed emission limit changes and has shown that compliance with the National Ambient Air Quality Standards (NAAQS) will be maintained. Huhtamaki Foodservice has requested an increase in individual dryer emission limits with an overall cap to maintain particulate matter emissions at the current level. IDEM in coordination with U.S. EPA, has modeled the proposed emission limit changes and has shown that compliance with the NAAQS will be maintained. U.S. EPA has also requested additional record keeping to show compliance with the combined limit.
The following sources have been repealed because all emission units listed in the rule are no longer operating or the entire source is closed:

IDEM seeks comment on the affected citations listed and any other provisions of Title 326 that may be affected by this rulemaking.
IC 13-14-9-4 Identification of Restrictions and Requirements Not Imposed under Federal Law
No element of the draft rule imposes either a restriction or a requirement on persons to whom the draft rule applies that is not imposed under federal law.
Potential Fiscal Impact
The proposed amendments will not have a fiscal impact on the affected sources. The proposed changes for Huhtamaki and Jupiter will provide the sources with operational flexibility.

SUMMARY/RESPONSE TO COMMENTS FROM THE FIRST COMMENT PERIOD
IDEM requested public comment from September 19, 2012, through October 19, 2012, on alternative ways to achieve the purpose of the rule and suggestions for the development of draft rule language. IDEM received comments from the following parties by the comment period deadline:
Autocar, LLC, submitted by Hatchett and Hauck LLP (AC)
Carmeuse Lime, Inc. (CL)
Harsco Minerals, submitted by Hatchett and Hauck LLP (HM)
Rolls Royce Corporation (RR)
Following is a summary of the comments received and IDEM's responses thereto:
Comment: Autocar's process identified in 326 IAC 6.5-10-6 is a "50 MMBtu/Hr" gas boiler. This unit is not in service and there are no plans to operate it. Autocar requests that 326 IAC 6.5-10-6 be repealed. Autocar also notes that particulate limits are not typically established for gas boilers in accordance with 326 IAC 6.5-1-1(b). For these reasons, 326 IAC 6.5-10-6 should be removed. (AC)
Response: IDEM has confirmed that the boiler is not operational and could not be operated without significant investment to restore steam supply lines. The boiler provided process steam for the business that owned the property previously. IDEM is proposing to repeal 326 IAC 6.5-10-6 as this boiler was the only emission unit listed in the rule. While particulate limits are not typically established for gas boilers some emission units located at other sources do have a natural gas fuel restriction limit.
Comment: Carmeuse believes that there are errors in the lb/hr limits for control device IDs ALG 450, 460, 600, 320, 400, 310, 300 and control device IDs AKG 141 and 450. Carmeuse is proposing new emission limits for these control devices. Carmeuse also believes the use of a lb/ton limit is not in any way related to the actual emissions in lb/hr from the filters and imposes an artificial limitation which is not consistent with operation of the control device. Response: Carmeuse has since submitted additional revisions to their request for new emission limits. IDEM continues to work with Carmeuse to develop air quality modeling that would support a SIP revision. Any new limits proposed for Carmeuse will be considered in a separate rulemaking.
Comment: The fluidized bed dryer listed in 326 IAC 6.8-2-29 at Harsco Minerals (formerly Reed Minerals) has been removed and should be deleted from the rule. This change is supported and explained in IDEM's Addendum to the Technical Support Document for Permit F089-00107. (HM)
Response: IDEM has updated the name at 326 IAC 6.8-2-29 and deleted the fluidized bed dryer from the rule.
Comment: Rolls-Royce has removed Boilers #1 through 4 at its Plant 5 and 326 IAC 6.5-6-33 should be revised to reflect the change. (RR)
Response: IDEM has verified the changes Rolls Royce has requested. IDEM has amended 326 IAC 6.5-6-33 accordingly.

(b) In addition to complying with section 1 of this rule and subsection (a), International Truck and Engine Corporation & Indianapolis Casting Corporation Navistar, Inc. shall comply with the following:
(1) Within thirty (30) days of the end of each calendar quarter, submit a written report to the department of the monthly emissions from each emission point identified in subsection (a) that contains information necessary to estimate emissions, including the following:
(A) For boilers, except if natural gas is burned, the following:
(i) Fuel type.
(ii) Usage.
(iii) Ash content.
(iv) Heat content.
(B) For other processes, the following:
(i) Appropriate production data.
(ii) Emission factors.
(iii) Proper documentation of the emission factors.
(2) The tons per year limitation shall be met based on the sum of the monthly emissions for each twelve (12) month period.

(A) When using only #4 fuel oil, the amount used for the listed boilers collectively is not to exceed thirty-seven million one hundred forty-two thousand eight hundred (37,142,800) gallons per year based on a three hundred sixty-five (365) day rolling figure.
(B) When using coal, #4 fuel oil, #6 fuel oil, #2 fuel oil, natural gas, or landfill gas, the limitation listed in clause (A) shall be adjusted as follows:
(i) When using #6 fuel oil, the gallons per year of #4 fuel oil shall be reduced by two and six-tenths (2.6) gallons per gallon used.
(ii) When using natural gas, the gallons per year of #4 fuel oil shall be reduced by eighty-eight hundred-thousandths (0.00088) gallon per cubic foot of natural gas burned.
(iii) When using #2 fuel oil, the gallons per year of #4 fuel oil shall be reduced by twenty-eight hundredths (0.28) gallon per gallon used.
(iv) When using landfill gas, the gallons per year of #4 fuel oil shall be reduced by one hundred sixteen hundred-thousandths (0.00116) gallon per cubic foot of landfill gas burned.
(4) (3) Maintain a log to document compliance with subdivision (3). (2). These records shall be:
(A) maintained for at least the previous twenty-four (24) month period; and
(B) made available upon request by the department.

Sec. 34. (a) Huhtamaki Foodservice, Inc., in Lake County, source identification number 00228, shall meet the following emission limits:

(b) In addition to complying with section 1 of this rule and subsection (a), Huhtamaki Foodservice, Inc. shall comply with the following:
(1) Maintain daily records for each dryer that contains sufficient information to calculate emissions, including the following:
(A) Dryer identification.
(B) Time and duration of operation for each dryer per day.
(C) Total quantity of molded pulp product passed through each dryer each day.
(D) PM10 emission data for the product which passed through each dryer, each day.
(2) Compliance with the individual dryer's emission limitation shall be on an hourly basis.
(3) Compliance with the combined lb/hr emission limitation shall be on a daily basis. Compliance shall be demonstrated by a calculation of the sum of the total pounds of PM10 emitted on each calendar day from all dryers which operated in that calendar day, divided by twenty-four (24) hours.
