TITLE 140 BUREAU OF MOTOR VEHICLES

DIGEST

Amends 140 IAC 8-3 concerning fees. Adds 140 IAC 8-5 concerning fees. Clarifies certain fees including commercial driver's licenses fees and delinquent license and registration renewal fees. Effective January 1, 2015.




SECTION 1. 140 IAC 8-3-1.1 IS AMENDED TO READ AS FOLLOWS:

140 IAC 8-3-1.1 Pull service charge

Sec. 1.1. (a) The pull service charge is the charge that the bureau of motor vehicles commission shall require for a requested low numbered motor vehicle registration plate or a special numbered motor vehicle registration plate as defined in subsections (b) through (c).

(b) As used in this rule, "low numbered motor vehicle registration plate" means any motor vehicle registration plate numbered from one (1) to one hundred (100) before or after the county designation number or letter series designation, or both.

(c) As used in this rule, "special numbered motor vehicle registration plate" means any plate, other than a low numbered motor vehicle registration plate, requested for issuance out of its established numerical sequence.

(d) The pull service charge for a low numbered motor vehicle registration plate or a special numbered motor vehicle registration plate is thirty dollars ($30), regardless of the remaining life of the plate, to be collected at the time of issuance.

(e) National Football League franchised professional football team license plates issued under IC 9-18-49 are exempted from this fee.

(e) (f) All bureau of motor vehicle and bureau of motor vehicle commission employees are prohibited from requiring, receiving, suggesting, or condoning any political contribution or other unauthorized payment in exchange for a low or special numbered motor vehicle registration plate. Any employee found to be in violation of this policy shall be subject to immediate dismissal from employment. Any other person who requires, receives, suggests, or condones a political contribution or other unauthorized payment for a low or special numbered motor vehicle registration plate or assignment thereof, shall be barred from participation in this allocation program and may be subject to criminal sanctions.

(f) (g) All amounts collected under this section shall be deposited in the state license branch fund.

Rule 5. Fees


140 IAC 8-5-1 Definitions

Sec. 1. (a) The definitions in this section apply throughout this rule.

(b) "Commission fund" has the meaning set forth in IC 9-13-2-32.7.

(c) "Crossroads 2000 fund" has the meaning set forth in IC 9-13-2-39.8.

(d) "Integrated public safety communications fund" has the meaning set forth in IC 9-13-2-82.5.

(e) "Motor vehicle highway account" has the meaning set forth in IC 9-13-2-105.3.

140 IAC 8-5-2 Chauffeur's license issued to individuals 85 and older fee

Authority: IC 9-14-2-2; IC 9-29-1-12; IC 9-29-3-19

Sec. 2. The fee for a chauffeur's license issued under IC 9-24-4 or renewed under IC 9-24-12 to an individual who is at least eighty-five (85) years of age is eighteen dollars and fifty cents ($18.50). The fee shall be distributed as follows:
(1) Fifty cents ($0.50) to the state motor vehicle technology fund.
(2) Four dollars ($4) to the crossroads 2000 fund.
(3) Six dollars ($6) to the motor vehicle highway account.
(4) For a chauffeur's license issued or renewed before July 1, 2019, as follows:
(A) One dollar and twenty-five cents ($1.25) to the integrated public safety communications fund.
(B) Six dollars and seventy-five cents ($6.75) to the commission fund.
(5) For a chauffeur's license issued or renewed after June 30, 2019, eight dollars ($8) to the commission fund.

140 IAC 8-5-3 Commercial driver's license upgrade or downgrade fee

Sec. 3. (a) The fee to add or remove a commercial driver's license endorsement other than at the time of license application is nineteen dollars ($19).

(b) All amounts collected under this section shall be deposited in the commission fund.

140 IAC 8-5-4 Motorcycle endorsements of commercial driver's license fee

Sec. 4. (a) The fee for validation of a motorcycle endorsement or motorcycle endorsement with a Class A motor driven cycle restriction under IC 9-24-8-4 and IC 9-24-12-7 of a commercial driver's license issued to an individual who is less than seventy-five (75) years of age is twelve dollars ($12). The fee shall be distributed as follows:
(1) One dollar ($1) to the crossroads 2000 fund.
(2) Two dollars and twenty-five cents ($2.25) to the motor vehicle highway account.
(3) One dollar ($1) to the state motor vehicle technology fund.
(4) For a motorcycle endorsement or motorcycle endorsement with a Class A motor driven cycle restriction validated before July 1, 2019, as follows:
(A) One dollar and twenty-five cents ($1.25) to the integrated public safety communications fund.
(B) Six dollars and fifty cents ($6.50) to the commission fund.
(5) For a motorcycle endorsement or motorcycle endorsement with a Class A motor driven cycle restriction validated after June 30, 2019, seven dollars and seventy-five cents ($7.75) to the commission fund.

(b) The fee for validation of a motorcycle endorsement or motorcycle endorsement with a Class A motor driven cycle restriction under IC 9-24-8-4 and IC 9-24-12-7 of a commercial driver's license issued to an individual who is at least seventy-five (75) years of age is ten dollars and fifty cents ($10.50). The fee shall be distributed as follows:
(1) One dollar ($1) to the crossroads 2000 fund.
(2) Seventy-five cents ($0.75) to the motor vehicle highway account.
(3) One dollar ($1) to the state motor vehicle technology fund.
(4) For a motorcycle endorsement or motorcycle endorsement with a Class A motor driven cycle restriction validated before July 1, 2019, as follows:
(A) One dollar and twenty-five cents ($1.25) to the integrated public safety communications fund.
(B) Six dollars and fifty cents ($6.50) to the commission fund.
(5) For a motorcycle endorsement or motorcycle endorsement with a Class A motor driven cycle restriction validated after June 30, 2019, seven dollars and seventy-five cents ($7.75) to the commission fund.

140 IAC 8-5-5 Delinquent license renewal fee

Sec. 5. (a) The delinquent registration fee shall be collected when a driver fails to renew his or her driver's license, in accordance with IC 9-24-12, on or prior to the license expiration date.

(b) The delinquent registration fee is five dollars ($5).

(c) All amounts collected under this section shall be deposited in the commission fund.

140 IAC 8-5-6 Delinquent registration renewal fee

Sec. 6. (a) The delinquent registration fee shall be collected when a registrant fails to apply for the registration of a vehicle or fails to provide full payment for the registration of a vehicle, or both, as required by IC 9-18, on or prior to the vehicle registration expiration date.

(b) The delinquent registration fee is five dollars ($5).

(c) All amounts collected under this section shall be deposited in the commission fund.

140 IAC 8-5-7 Title history fee

Sec. 7. (a) The fee for a title history report is eight dollars ($8).

(b) All amounts collected under this section shall be deposited in the commission fund.

140 IAC 8-5-8 Civic event license plate fee

Sec. 8. (a) The fee for a civic event license plate issued under IC 9-18-24-1 is twenty-one dollars ($21).

(b) The fee shall be distributed as follows:
(1) Eight dollars ($8) to the commission fund.
(2) Eight dollars ($8) to the motor vehicle highway account.
(3) Five dollars ($5) to the crossroads 2000 fund.

(c) The commissioner may waive this fee if, in his or her opinion, the waiver would be in the best interest of the bureau.

140 IAC 8-5-9 Surtax collection service charge

Sec. 9. (a) The bureau may impose a service charge of fifteen cents ($0.15) for each county motor vehicle excise surtax collection made under IC 6-3.5-4.

(b) The service charge shall be deposited in the commission fund.

140 IAC 8-5-10 Wheel tax collection service charge

Sec. 10. (a) The bureau may impose a service charge of fifteen cents ($0.15) for each county wheel tax collection made under IC 6-3.5-5.

(b) The service charge shall be deposited in the commission fund.

SECTION 3. THE FOLLOWING ARE REPEALED: 140 IAC 8-3-10; 140 IAC 8-3-14.

SECTION 4. SECTIONS 1 through 3 of this document take effect January 1, 2015.
