IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
The proposed rules remove fees for services now offered online, remove the minimum number of embalmings required to gain experience for the funeral director license, add an additional attempt at the funeral director examination before having to obtain additional education, remove the requirement for continuing education providers to provide an outline to course attendees, and remove the burdensome deadline to file a funeral home application. The proposed rules also repeal a rule that prohibits funeral directors with an expired license from reinstating.
The proposed rule changes will not increase or decrease the number of small businesses already affected by the current regulations. The types of small businesses most likely to be affected by the proposed rule are funeral homes and continuing education sponsors.
Under the proposed rules, rules affecting small businesses are either repealed or amended as follows:
• Removes fees for services now offered online, removes the minimum number of embalmings required to gain experience for the funeral director license, adds an additional attempt at the funeral director examination before having to obtain additional education, removes the requirement for continuing education providers to provide an outline to course attendees, and removes the burdensome deadline to file a funeral home application. The proposed rule also repeals a rule that prohibits funeral directors with an expired license from reinstating.

Impact on Small Businesses

The proposed rule eliminates a fee for duplicate wall certificate. The proposed rule does not impose any additional reporting, record keeping, or administrative costs.

3. Estimate of the total annual economic impact that compliance with the proposed rule will have on all small businesses subject to the rule.
The proposed rule will not impose any additional cost on the funeral home or continuing education sponsor.

4. Statement justifying any requirement or cost that is imposed on small businesses by the rule; or any other state or federal law.
The proposed rule will not impose any additional cost on the funeral home or continuing education sponsor.

5. Regulatory flexibility analysis
Consideration of alternative methods of achieving the purpose of the proposed rule.
The purpose of the proposed rule is to remove fees and barriers to practice. There are no alternative methods of achieving the purpose of the proposed rule.

Conclusion
The proposed rules are necessary to reduce fees and to remove barriers to become licensed and to practice.
