Notice of Public Hearing
Under
IC 4-22-2-24, notice is hereby given that on May 29, 2014, at 10:00 a.m., at the Indiana Government Center South, 302 West Washington Street, Conference Center, Indianapolis, Indiana, the Indiana Secretary of State - Auto Dealer Services Division will hold a public hearing on a new proposed rule that repeals
75 IAC 2 and
75 IAC 4 and replaces it with a new
75 IAC 6 to implement licensing, plate process, and other requirements for the Auto Dealer Services Division under the guidance of newly enacted
IC 9-32.
The Indiana Secretary of State - Auto Dealer Services Division has the authority to promulgate rules in accordance with the requirements of
IC 4-22-2-23. It is estimated that all small businesses licensed by the Auto Dealer Services Division will be subject to the proposed rule; however, we do not anticipate financial impact to many, if any, legitimate business locations. The proposed rule may increase costs for a licensed wholesale dealer if the licensed wholesale dealer's established place of business is not compliant with what currently exists in
IC 9-32. These costs are associated with the minimal standards necessary to ensure a safe environment for business operations and Division Investigators to visit when auditing Indiana wholesale dealers. The proposed rule merely further develops what is required by current statute,
IC 9-32.
Copies of these rules are now on file at the Indiana Secretary of State-Auto Dealer Services office, 302 West Washington Street, Room E111 and Legislative Services Agency, Indiana Government Center North, 100 North Senate Avenue, Room N201, Indianapolis, Indiana and are open for public inspection.
