RE: LSA Document #13-341 – Proposed Rule that adds 675 IAC 22-2.5 to adopt the 2012 International Fire Code, first printing, with Indiana amendments to create the 2014 Indiana Fire Code and repeals 675 IAC 22-2.4 (2008 Indiana Fire Code)

Dear Representative Thompson:

On behalf of the Indiana Fire Prevention and Building Safety Commission, I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25, which requires that a notice be sent if a rule will not be signed by the Governor within one year of publication of the Notice of Intent to Adopt a Rule. This notice is to be filed by the two hundred fiftieth day following the publication of the Notice of Intent to Adopt a Rule.

The notice of intent for this rule was published in the Indiana Register on July 24, 2013 (DIN: 20130724-IR-675130341NIA). The rule is updating the Indiana Fire Code for the first time in more than 6 years in order to allow for additional alternative methods and materials for compliance and the evaluation of the fiscal impact is taking an extended period of time, longer than the Commission anticipated. In order to ensure that the fiscal impact is accurately evaluated, the Commission expects that the rule will be approved by the Governor not later than June 30, 2015.

This notice setting forth the expected date of approval of LSA Document #13-341 as June 30, 2015, is being submitted in a timely manner. March 31, 2014, is the two hundred fiftieth day after publication of the Notice of Intent to Adopt a Rule.
