RE: LSA Documents [sic] #13-171 – Proposed Rule Amending 511 IAC 7-33 to Align with New Federal Regulations

Dear Representative Thompson:

On behalf of the Indiana Board of Education, I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25, which requires that a notice be sent if a rule will not be signed by the Governor within one year of publication of the Notice of Intent to Adopt a Rule. This notice is to be filed by the two hundred fiftieth day following the publication of the Notice of Intent to Adopt a Rule.

The notice of intent for this rule was published in the Indiana Register on May 8, 2013 (DIN: 20130508-IR-511130171NIA). May 8, 2013, through Friday, January 3, 2014, is 240 days.

Due to extended deliberations, the Board will not be able to complete the rulemaking process by May 8, 2014. The language for the Proposed Rule has been approved and submitted for publication. We expect to hold the public hearing in February and take final language to the Board in March. Final approval by the Governor is expected no later than July 31, 2014.
