TITLE 675 FIRE PREVENTION AND BUILDING SAFETY COMMISSION

Temporarily adds noncode provisions to regulate the design, installation, inspection, use, and maintenance of outdoor event equipment to implement HEA1069, P.L.142-2013. Effective January 1, 2014.
SECTION 1. (a) This document contains building and fire safety rules applicable to outdoor event equipment, as defined in IC 22-12-1-17.7.
(b) Outdoor event equipment may include the following:
(1) Flying PA towers.
(2) PA scaffold towers.
(c) This document does not regulate any stage or platform, whether temporary or permanent, including any audio, lighting, video, or scenic components, with or without associated trusses, roofs, towers, or other supporting construction, that is anchored to or attached to any stage or platform. For the building and fire safety rules applicable to such stages and platforms, see 675 IAC 12, 675 IAC 13, 675 IAC 16, 675 IAC 17, 675 IAC 18, 675 IAC 19, 675 IAC 21, and 675 IAC 22.
(d) For purposes of the definition of "outdoor event equipment", the phrase "is not part of another Class 1 structure" means that the outdoor event equipment is designed, constructed, and installed separately from any other Class 1 structure, such as a stage or platform, and is, or is intended to be, an independent, standalone Class 1 structure.
SECTION 2. (a) Notwithstanding 675 IAC 12-6-2, for purposes of this document, "temporary outdoor event equipment" means outdoor event equipment that is installed at any single location in Indiana for not more than forty-five (45) calendar days in any one (1) calendar year.
(b) A construction design release, as described in 675 IAC 12-6, is not required for temporary outdoor event equipment.
(c) Notwithstanding 675 IAC 12-6-2, for purposes of this document, "permanent outdoor event equipment" means outdoor event equipment that is installed at any single location in Indiana for more than forty-five (45) calendar days in any calendar year.
(d) A construction design release, as described in 675 IAC 12-6, is required for permanent outdoor event equipment.
SECTION 3. The following definitions apply throughout this document:
(1) "Building Code" means the Indiana Building Code (675 IAC 13) in effect on the date that the outdoor event equipment is first installed at any location in Indiana.
(2) "Chapters 26, 29, 30, and 31 and Section 1.2.1 of ASCE 7" means the documents incorporated by reference in SECTION 6 of this document.
(3) "Commission" means the fire prevention and building safety commission created pursuant to IC 22-12-2.
(4) "Competent person" means an individual who, through education, training, and experience, is capable of performing the periodic inspections of outdoor event equipment required under this document.
(5) "Division" means the division of fire and building safety of the Indiana department of homeland security created pursuant to IC 10-19-12.
(6) "Inspection authority" means the division, the local building official authorized under IC 36-7-2-9 and local ordinance, and the local fire department authorized under IC 36-8-17-8.
(7) "Owner" means the person or entity that holds title to the real estate on which the outdoor event equipment is located.
(8) "Scenic components" means decorative components of outdoor event equipment that are not directly connected to the audio, lighting, or video systems in the outdoor event equipment.
(9) "Severe weather" means thunderstorms, tornadoes, flooding, high winds, hailstorms, or other similar, natural weather events.
SECTION 4. (a) Temporary outdoor event equipment that does not exceed twenty (20) feet above the surface of the stage or platform and that meets both of the following conditions is not subject to regulation under this document:
(1) For each foot of height from the ground to the highest point of the outdoor event equipment, all members of the public shall be placed an equal distance from the outdoor event equipment, plus an additional eight (8) feet. In no case shall the overall height of the outdoor event equipment exceed twenty (20) feet above the surface of the stage or platform.
(2) Except for installation and dismantling of the outdoor event equipment, no person is located within any portion or part of the outdoor event equipment.
(b) Temporary outdoor event equipment that is not subject to regulation under this document is subject to inspection by the inspection authority for compliance with the exemption in subsection (a).
SECTION 5. (a) The owner shall have all plans and specifications for each configuration of outdoor event equipment, including, without limitation, each configuration of structural design, and audio, lighting, video, and scenic components, prepared by an individual who is:
(1) competent to design the outdoor event equipment; and
(b) Each and every page of all plans and loose page specifications, and the title page of bound specifications, shall include the legible signature and the seal of the individual described in subsection (a).
(c) Such plans and specifications shall include all of the following, as applicable:
(1) A site plan drawn to scale, showing dimensioned location of building property lines, and to all adjacent buildings on the property, as well as width of any street or easements bordering the property, as well as the intended location of the audience.
(2) Foundation or other anchorage plans and details, including, without limitation, guying systems and ground anchorage.
(3) Sections and details of all elements, including roofs, showing the following:
(4) Structural plans and elevations showing size and location of all members, truss designs showing all connection details, and all stress calculations.
(5) Details indicating how required structural integrity will be with respect to:
(A) electrical; and
conduit, pipes, and similar systems.
(6) Construction specifications.
(7) Electrical plans showing:
(A) the electrical distribution system;
(B) the service equipment;
(C) the grounding methods;
(D) the emergency and standby power systems.
(8) Additional information as may be required by the division to show that the outdoor event equipment will comply with the rules of the commission.
(9) Installation or erection and dismantling instructions.
(d) Design loads, including wind, snow, and seismic loads, shall comply with the provisions of the building code and Chapters 26, 29, 30, and 31 and Section 1.2.1 of ASCE 7.
(e) Maximum limits of loads imposed by audio, lighting, video, and scenic components shall be included in the plans and specifications.
SECTION 6. (a) Section 1.2.1 of Chapter 1, as contained at pages 1-2, Chapter 26, as contained at pages 241-258, Chapter 29, as contained at pages 307-314, Chapter 30, as contained at pages 315-355, and Chapter 31, as contained at pages 357-358 of that certain document being titled ASCE/SEI 7-10 Minimum Design Loads for Buildings and Other Structures, 2010 Edition, second printing, as published by the American Society of Civil Engineers, 1801 Alexander Bell Dr., Reston, VA 20191, are hereby adopted by reference as if fully set out in this document save and except those revisions made in this document.
(b) Section 1.2.1 of Chapter 1 is hereby amended as follows:
(1) The definition of "Authority Having Jurisdiction" is amended to read as follows: "Authority Having Jurisdiction" means the inspection authority.
(2) The definition of "Other Structures" is amended to read as follows: "Other Structures" means outdoor event equipment as defined in IC 22-12-1-17.7.
(3) The definition of "Temporary Facilities" is amended to read as follows: "Temporary Facilities" means temporary outdoor event equipment, as defined in SECTION 2(a) of this document.
(c) Section 26.2 of Chapter 26 is hereby amended to delete the definition of "Approved" and substitute as follows: APPROVED as to materials, equipment, design, and types of construction, means acceptance by the inspection authority by one (1) of the following methods:
(i) investigation or tests conducted by recognized authorities; or
(ii) investigation or tests conducted by technical or scientific organizations; or
(iii) accepted principles.
The investigation, tests, or principles shall establish that the materials, equipment, and types of construction are safe for their intended purpose.
SECTION 7. The owner shall submit the plans and specifications required in SECTION 5 of this document, under an affidavit that such plans and specifications comply with the requirements of this document, to the inspection authority at each location in Indiana at which the outdoor event equipment is used not less than fourteen (14) calendar days prior to the first use of the outdoor event equipment at each such location in each calendar year.
SECTION 8. The owner shall maintain the outdoor event equipment at all times in a condition at least as safe as it was when it was first constructed and installed in accordance with this document.
SECTION 9. The owner shall have the outdoor event equipment inspected by a competent person to determine continuing compliance with the requirements of this document each time the outdoor event equipment is installed and each time it is dismantled.
SECTION 10. The person or entity that holds title to the outdoor event equipment shall ensure that the outdoor event equipment is manufactured and installed in accordance with the requirements of this document.
SECTION 11. The person or entity that installs the outdoor event equipment shall ensure that the installation complies with the requirements of SECTION 5(c)(9) of this document.
SECTION 12. (a) The owner shall create and implement an emergency response plan to provide for the safe dismantling of the outdoor event equipment and evacuation of all persons from the area in which the outdoor event equipment is located in the event of severe weather or other natural disaster.
(b) The emergency response plan shall be created by a person with appropriate education, training, and experience in emergency response planning and implementation for outdoor events.
(c) The emergency response plan shall, at a minimum, contain the following:
(1) A description of the conditions under which the plan will be implemented, including, without limitation, specified wind speeds and proximity of severe weather events to the site where the outdoor event equipment is located.
(2) The response actions to be taken in the event of each of the specified conditions, including, without limitation, the person or entity responsible to performing each such response action.
SECTION 13. SECTIONS 1 through 12 of this document take effect on January 1, 2014.
