TITLE 513 COMMISSION ON SECLUSION AND RESTRAINT IN SCHOOLS

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Commission on Seclusion and Restraint in Schools intends to adopt a rule concerning the following:

OVERVIEW: Adds 513 IAC, a new title, to the Indiana Administrative Code called Commission on Seclusion and Restraint in Schools. Adds provisions to 513 IAC to provide for rules regarding the use of restraint and seclusion in a school corporation or an accredited nonpublic school, with an emphasis on eliminating or minimizing the use of restraint and seclusion. Adds provisions to 513 IAC to provide for rules regarding the prevention of the use of types of restraint or seclusion that may harm a student, a school employee, a school volunteer, or the educational environment of the school. Adds provisions to 513 IAC to provide for rules regarding the requirements for notifying parents. Adds provisions to 513 IAC to provide for rules regarding the training requirements regarding the use of restraint and seclusion, including the frequency of training and what employees must be trained. Adds provisions to 513 IAC to provide for rules regarding the distribution of a schools' seclusion and restraint policy or plan to parents and the public. Adds provisions to 513 IAC to provide for rules regarding the requirements for the reporting of incidents of restraint and seclusion in the annual school performance report.
