Dear Representative Thompson,

On behalf of the Indiana Real Estate Commission (Commission), I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25, because the Commission has determined that the promulgation of the captioned rule may not be completed within one year after publication of the Notice of Intent to Adopt a Rule.

The Commission published its Notice of Intent to Adopt a Rule on November 14, 2012 (DIN: 20121114-IR-876120609NIA). The Commission submitted the proposed rule for approval by the State Budget Agency (SBA) on November 26, 2012. The Commission did not receive approval from the SBA until July 11, 2013. The Commission expects to hold a public hearing on the proposed rule at its October 31, 2013, meeting.

Following the public hearing, the rule will be submitted to the Attorney General for review. Once approved by the Attorney General, the rule will be forwarded to the Governor for approval. Thus, promulgation of this rule will not be completed by November 14, 2013.

This notice, setting forth the expected date of approval of LSA Document #12-609 as March 15, 2014, is being submitted in a timely manner. July 22, 2013, is the two hundred and fiftieth day after the publication of the Notice of Intent to Adopt a Rule.
