Senator Young,

On behalf of the Indiana Commission on Public Records (Commission), I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25, as the Commission has determined that the promulgation of the stated rule may not be completed within one year after publication of the Notice of Intent to Adopt a Rule.

The Commission published its Notice of Intent to Adopt a Rule for the stated rule on October 31, 2012 (DIN: 20121031-IR-060120580NIA). On November 26, 2012, the Commission submitted the rule packet for review by the State Budget Agency. On February 13, 2013, the Commission submitted a report of pending, nonfinal rule to the State Budget Agency as required by OMB Financial Management Circular #2013-01.

Following approval by the State Budget Agency, the Commission will submit the proposed rule and corresponding economic impact statement to the Indiana Register and Administrative Code Division (IRACD) of the Legislative Services Agency. Once the Commission receives the intended date of publication from the IRACD, the Commission will submit and publish a notice of public hearing. After more than 21 days, the Indiana Oversight Committee on Public Records (OCPR) will hold a public hearing. The Commission believes the rule will gain OCPR approval at this time but cannot be certain. Following approval by the OCPR, the Commission will submit the final rule to the Office of Attorney General, which following approval, will forward it to the Office of the Governor, then to the IRACD. As many of these steps are contingent on processes and approvals that are out of the Commission's control, the Commission expects that the rule can be approved by the governor by December 31, 2014.

This notice setting forth the expected date of approval of LSA Document #12-580 as December 31, 2014, is being submitted in a timely manner. July 8, 2013, is the two hundred and fiftieth day after publication of the Notice of Intent to Adopt a Rule.
