RE: LSA Document #12-522 - The proposed rule amends 675 IAC 28-1-28 to update to the 2010 edition of NFPA 72, National Fire Protection Association Standard for the National Fire Alarm and Signaling Code, makes conforming changes, and repeals 675 IAC 13-1-9 (NFPA 14) and 675 IAC 28-1-22 (NFPA 58)


Dear Senator Young:

On behalf of the Fire Prevention and Building Safety Commission (Commission), I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25, because the Commission has determined that the promulgation of the captioned rule may not be completed within one year after publication of the Notice of Intent to Adopt a Rule. The Commission published its Notice of Intent to Adopt a Rule for LSA Document #12-522 on September 12, 2012, at DIN: 20120912-IR-675120522NIA. The rule updates the NFPA 72 Standard for the first time in more than seven years to allow for the use of updated technologies, and repeals two outdated regulations. The evaluation of the fiscal impact is taking an extended period of time, longer than the Commission anticipated. In order to ensure that the fiscal impact is accurately evaluated, the Commission expects that the rule will be approved by the Governor not later than June 30, 2014.

This notice setting forth the expected date of approval of LSA Document #12-522 as June 30, 2014, is being submitted in a timely manner. May 19, 2013, is the two hundred fiftieth day after publication of the Notice of Intent to Adopt a Rule.
