TITLE 460 DIVISION OF DISABILITY AND REHABILITATIVE SERVICES

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Division of Disability and Rehabilitative Services intends to adopt a rule concerning the following:

OVERVIEW: Amends 460 IAC 6 to establish standards for providers of services administered by the Division of Disability and Rehabilitative Services (DDRS) through the Home and Community Based Services Waivers approved by the Centers for Medicare and Medicaid Services. Amends 460 IAC 6-3 (definitions), 460 IAC 6-4 (services covered), 460 IAC 6-6 (application). Adds 460 IAC 6-6-7 concerning accreditation. Amends 460 IAC 6-7-5 concerning revocation of provider approval. Amends 460 IAC 6-9-3 concerning rights of individuals. Amends 460 IAC 6-9-5 and adds 460 IAC 6-9-5.1 and 460 IAC 6-9-5.2 concerning incident reporting and investigations. Amends 460 IAC 6-9-6 and 460 IAC 6-9-7 and adds 460 IAC 6-9-9 and 460 IAC 6-9-10 concerning transitions. Amends 460 IAC 6-10-5, 460 IAC 6-10-7, and 460 IAC 6-10-10 through 460 IAC 6-10-12 and adds 460 IAC 6-10-5.1 and 460 IAC 6-10-7.1 to include document and quality assurance requirements. Amends 460 IAC 6-11-2 to include financial requirements. Amends 460 IAC 6-12-2 to include insurance requirements. Amends 460 IAC 6-14-3 through 460 IAC 6-14-5 and 460 IAC 6-14-7 concerning support staff requirements. Amends 460 IAC 6-15-2, 460 IAC 6-16-2, 460 IAC 6-16-4, and 460 IAC 6-17-2 through 460 IAC 6-17-4 concerning personnel and operations. Amends 460 IAC 6-18-2 and 460 IAC 6-19-9 concerning behavioral support plans. Amends 460 IAC 6-24-3 to ensure proper management of an individual's finances. Amends 460 IAC 6-25-1 through 460 IAC 6-25-3 concerning coordination of health care. Amends 460 IAC 6-25-10 concerning mortality reviews. Amends 460 IAC 6-29-1 through 460 IAC 6-29-7 to ensure safe environments for individuals. Amends 460 IAC 6-36-2 concerning ethics. Adds 460 IAC 6-37 concerning imminent danger and restrictive interventions. Adds 460 IAC 6-38 concerning advance directives. Adds 460 IAC 6-39 concerning placement authority. Adds 460 IAC 6-40 to include provider auto-assignment. Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-5, specifically IC 5-28-17-5(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
