TITLE 876 INDIANA REAL ESTATE COMMISSION

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Indiana Real Estate Commission intends to adopt a rule concerning the following:

OVERVIEW: Amends 876 IAC 3-2-5 regarding the requirements to reinstate an expired license. Amends 876 IAC 3-3-3.1, 876 IAC 3-3-4.1, and 876 IAC 3-3-5.1 to remove expired language. Amends 876 IAC 3-3-9 to extend the time frame for acceptable experience credit. Amends 876 IAC 3-3-13.1 and 876 IAC 3-3-13.2 to identify the maximum hour value for each appraisal that may qualify for experience credit. Amends 876 IAC 3-5-1 clarifying the point at which a trainee licensee has to complete the USPAP continuing education course. Amends 876 IAC 3-5-1.5 regarding the time frame a licensee has to complete the USPAP continuing education course each renewal cycle. Makes other conforming and technical amendments. Comments and questions may be addressed to the Small Business Regulatory Coordinator for this rule. Statutory authority: IC 25-34.1-3-8.

Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-5, specifically IC 5-28-17-5(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
