Amends 511 IAC 12-2-1 and 511 IAC 12-2-2 to establish new procedures for summer school funding. Repeals 511 IAC 12-2-6. Effective 30 days after filing with the Publisher.




SECTION 1. 511 IAC 12-2-1 IS AMENDED TO READ AS FOLLOWS:

511 IAC 12-2-1 Reimbursement; approval of classes

Sec. 1. (a) On or before January 15, the state board shall announce the summer school and intersession classes that will be approved for reimbursement by the department. The state board shall place each Indiana state approved course into one (1) of the following three (3) categories:
(1) Category 1.
(2) Category 2.
(3) Category 3.
Courses placed in Category 1 shall receive the highest priority in funding. Courses placed in Category 2 shall receive the second highest priority in funding. Courses placed in Category 3 shall receive the lowest priority in funding.

(b) On or before April 1, each school corporation shall forward to the department a list of all classes to be offered in summer school and intersession for which the school corporation will seek reimbursement. This list shall include the following:
(1) The course code from the Indiana state approved course titles and descriptions.
(2) The number of students enrolled in each course.

(c) On or before May 15, the department shall notify school corporations of their estimated per pupil reimbursement based on lists submitted under subsection (b).

SECTION 2. 511 IAC 12-2-2 IS AMENDED TO READ AS FOLLOWS:

Sec. 2. (a) On or before January 15, the state board shall announce a maximum per pupil reimbursement for Category 1, Category 2, and Category 3 courses.

(b) On or before January 15, the state board shall announce a funding share for school corporations that operate on a traditional school calendar of the total summer school education funds appropriated by the general assembly under IC 20-30-7-1.

(c) On or before January 15, the state board shall announce a funding share for school corporations that operate on a balanced school calendar of the total summer school education funds appropriated by the general assembly under IC 20-30-7-1.

(a) (d) The department shall reimburse school corporations that operate on a traditional school calendar for approved summer school classes in accordance with the following formula:
(1) the amount expended for the instructional costs of approved programs; multiplied by
(2) 1.05;
(3) reduced proportionately if the appropriation is insufficient to fund all approved programs at one hundred percent (100%).

(b) Instructional costs include only teacher salaries and teacher aide wages.
STEP ONE: Determine the amount appropriated to school corporations that operate on a traditional school calendar under subsection (b).
STEP TWO: Determine the number of eligible students under Category 1, Category 2, and Category 3 for whom reimbursement was requested under Section 1 by school corporations that operate on a traditional school calendar.
STEP THREE: Divide:
(A) the amount determined in STEP ONE; by
(B) the number of students in Category 1 as determined in STEP TWO.
STEP FOUR: If the result of STEP THREE is less than the maximum per pupil amount for Category 1 established under subsection (a), multiply:
(A) the STEP THREE result; by
(B) the number of students in Category 1 as determined in STEP TWO.
STEP FIVE: If the result of STEP THREE exceeds the maximum per pupil amount for Category 1 established under subsection (a), multiply:
(A) the maximum per pupil amount for Category 1 established under subsection (a); by
(B) the number of students in Category 1 as determined in STEP TWO.
STEP SIX: Subtract:
(A) the total amount allocated under STEP FOUR or STEP FIVE; from
(B) the amount determined in STEP ONE.
STEP SEVEN: Divide:
(A) the amount determined in STEP SIX; by
(B) the number of students in Category 2 determined in STEP TWO.
STEP EIGHT: If the result of STEP SEVEN is less than the maximum per pupil amount for Category 2 established under subsection (a), multiply:
(A) the STEP SEVEN result; by
(B) the number of students in Category 2 determined in STEP TWO.
STEP NINE: If the result of STEP SEVEN exceeds the maximum per pupil amount for Category 2 established under subsection (a), multiply:
(A) the maximum per pupil amount for Category 2 established under subsection (a); by
(B) the number of students in Category 2 as determined in STEP TWO.
STEP TEN: Subtract:
(A) the total amount allocated under STEP EIGHT or STEP NINE; from
(B) the amount determined in STEP SIX.
STEP ELEVEN: Divide:
(A) the amount determined in STEP TEN; by
(B) the number of students in Category 3 as determined in STEP TWO.
STEP TWELVE: If the result of STEP ELEVEN is less than the maximum per pupil amount for Category 3 established under subsection (a), multiply:
(A) the STEP ELEVEN result; by
(B) the number of students in Category 3 as determined in STEP TWO.
STEP THIRTEEN: If the result of STEP ELEVEN exceeds the maximum per pupil amount for Category 3 established under subsection (a), multiply:
(A) the maximum per pupil amount for Category 3 established under subsection (a); by
(B) the number of students in Category 3 as determined in STEP TWO.
STEP FOURTEEN: Subtract:
(A) the total amount allocated under STEP TWELVE or STEP THIRTEEN; from
(B) the amount determined in STEP TEN.

(e) The department shall reimburse school corporations that operate on a balanced school calendar for approved summer school classes in accordance with the following formula:
STEP ONE: Determine the amount appropriated to school corporations that operate on a balanced school calendar under subsection (c).
STEP TWO: Determine the number of eligible students in Category 1, Category 2, and Category 3 for which reimbursement was requested under Section 1 by school corporations that operate on a balanced school calendar.
STEP THREE: Divide:
(A) the amount determined in STEP ONE; by
(B) the number of students in Category 1 determined in STEP TWO.
STEP FOUR: If the result of STEP THREE is less than the maximum per pupil amount for Category 1 established under subsection (a), multiply:
(A) the STEP THREE result; by
(B) the number of students in Category 1 determined in STEP TWO.
STEP FIVE: If the result of STEP THREE exceeds the maximum per pupil amount for Category 1 established under subsection (a), multiply:
(A) the maximum per pupil amount for Category 1 established under subsection (a); by
(B) the number of students in Category 1 determined in STEP TWO.
STEP SIX: Subtract:
(A) the total amount allocated under STEP FOUR or STEP FIVE; from
(B) the amount determined in STEP ONE.
STEP SEVEN: Divide:
(A) the amount determined in STEP SIX; by
(B) the number of students in Category 2 as determined in STEP TWO.
STEP EIGHT: If the result of STEP SEVEN is less than the maximum per pupil amount for Category 2 established under subsection (a), multiply:
(A) the STEP SEVEN result; by
(B) the number of students in Category 2 determined in STEP TWO.
STEP NINE: If the result of STEP SEVEN exceeds the maximum per pupil amount for Category 2 established under subsection (a), multiply:
(A) the maximum per pupil amount for Category 2 established under subsection (a); by
(B) the number of students in Category 2 as determined in STEP TWO.
STEP TEN: Subtract:
(A) the total amount allocated under STEP EIGHT or STEP NINE; from
(B) the amount determined in STEP SIX.
STEP ELEVEN: Divide:
(A) the amount determined in STEP TEN; by
(B) the number of students in Category 3 determined in STEP TWO.
STEP TWELVE: If the result of STEP ELEVEN is less than the maximum per pupil amount for Category 3 established under subsection (a), multiply:
(A) the STEP ELEVEN result; by
(B) the number of students in Category 3 determined in STEP TWO.
STEP THIRTEEN: If the result of STEP ELEVEN exceeds the maximum per pupil amount for Category 3 established under subsection (a), multiply:
(A) the maximum per pupil amount for Category 3 established under subsection (a); by
(B) the number of students in Category 3 determined in STEP TWO.
STEP FOURTEEN: Subtract:
(A) the total amount allocated under STEP TWELVE or STEP THIRTEEN; from
(B) the amount determined in STEP TEN.

(f) If the result of:
(1) STEP FOURTEEN in subsection (d) is greater than zero (0); or
(2) STEP FOURTEEN in subsection (e) is greater than zero (0);
the department shall send written notice to each school corporation that shall include the total amount of remaining dollars in the summer school fund and the process that each school corporation must follow to apply for the remaining dollars.

(g) The process for remaining dollars shall be a competitive grant process to be published annually no later than March 31.

SECTION 3. 511 IAC 12-2-6 IS REPEALED.
