IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Estimated Number of Small Businesses Subject to this Rule:
140 commercial deer processors.
Estimated Average Annual Reporting, Record Keeping, and Other Administrative Costs Small Businesses Will Incur for Compliance:
$50 per year for an estimated time of five hours per year ($10 per hour) to complete the log sheets/records and submit the application form.
Estimated Total Annual Economic Impact on Small Businesses to Comply:
$50 per year to complete the records required for deer processed by a commercial deer processor.
Justification Statement of Requirement or Cost
Commercial deer processors are already required to record information when a deer is received for processing and register with the department annually. These proposed changes require a processor to record the electronic harvest confirmation number if the deer has been reported (checked-in) electronically. Another change will require commercial deer processors to register by March 1 of each year. Currently, there is no deadline for registering with the department each year, and many of them are registering after they are already processing deer. By adding a deadline, the DNR will know who the processors are in advance and ensure compliance with record keeping and registration requirements.
Regulatory Flexibility Analysis of Alternative Methods:
The DNR could also change the date in which a commercial deer processor has to register, but the date needs to be early enough in the year to be prior to the processing of deer. Some processors are open when deer are taken under damage control permits. These permits are oftentimes issued in the spring. With this deadline, the DNR will know who the processors are in advance and be able ensure compliance with record keeping and registration requirements.
