Public Notice Regarding Changes in Statewide Methods and Standards for
Setting Payments for Medicaid Enrolled Intermediate Care Facilities for the Mentally Retarded

In accordance with the public notice requirements of 42 CFR 447.205 and Section 1902(a)(13)(A) of the Social Security Act, the Indiana Family and Social Services Administration (IFSSA), Office of Medicaid Policy and Planning (OMPP) publishes this notice of proposed changes to the reimbursement methodology for nonstate-operated intermediate care facilities for the mentally retarded.

The OMPP proposes to modify the rate setting formula for large private Intermediate Care Facilities for the Mentally Retarded (ICFs/MR) (codified at 405 IAC 1-12). A new ICF/MR licensure level to be known as the Comprehensive Rehabilitative Management Facility will be developed. This new licensure level will provide supports and services for adults who not only meet the requirements for ICF/MR level of care, but may have a dual diagnosis and acute and high risk challenges. These individuals are also in need of a comprehensive service delivery in the areas of behavioral and psychiatric supports.

This new large private ICF/MR licensure level is necessary due to the closure of the state ICF/MR facilities. Many of the residents from the former state ICF/MR facilities will be placed in this new licensure level. The Indiana Division of Disability and Rehabilitative Services (DDRS) has determined that there are no existing licensure levels appropriate for this population and that a new licensure level would be needed. This licensure level will also receive residents currently in existing living arrangements that would more appropriately be placed in this new licensure level.

Also, a copy of this notice is now available and may be inspected by contacting the local county office of the Division of Family Resources, except in Marion County, where public inspection may be made at the Office of Medicaid Policy and Planning at 402 West Washington Street, Room W374, Indianapolis, Indiana.
