Under IC 4-22-2-24, notice is hereby given that on August 9, 2012, at 9:30 a.m., at the Indiana Government Center North, 100 North Senate Avenue, Indiana Education Employment Relations Board Meeting Room, Room N1045, Indianapolis, Indiana, the Indiana Education Employment Relations Board will hold a public hearing on proposed rules amending and adding to 560 IAC 2 to comply with the 2011 legislative amendments to IC 20-29 and to modernize procedures.

LSA Document #12-112 is necessary to assure that Indiana Education Employment Relations Board procedures, particularly mediation and fact-finding, reflect and are in compliance with IC 20-29, which was significantly amended in 2011. The legislative changes establish timelines for bargaining, limit the number of mediation sessions, require the parties to submit last, best offers, and make fact-finding decisions binding and appealable to the Indiana Education Employment Relations Board. 560 IAC, as it currently exists, does not include procedures to accommodate any of these legislative changes. LSA Document #12-112 fills in this gap and replaces procedures that are now contrary to law. The proposed rule directly affects all 309 Indiana school corporations and the school employee organizations serving as exclusive representatives to teachers. The most significant impact would occur in situations where the parties reach an impasse in their collective bargaining negotiations. Without this proposed rule, the Indiana Education Employment Relations Board would be unable to provide impasse services that comply with IC 20-29.
