TITLE 355 STATE CHEMIST OF THE STATE OF INDIANA

The proposed rule amendment will not impose requirements or costs on small businesses under IC 4-22-2.1-5. The proposed rule amendment is a schedule of civil penalties, to now include violations to the Fertilizer Material Use, Distribution and Record Keeping Rule 355 IAC 8, the Office of Indiana State Chemist may impose on persons that violate IC 15-16-2, the Commercial Fertilizer Law, or rules adopted under that chapter. Those that violate are subject to IC 15-16-2-49.5:

Sec. 49.5. (a) If a person violates this chapter or a rule adopted under this chapter, the state chemist may:

(1) warn, issue a citation to, or impose a civil penalty on the person; or

(2) deny, suspend, revoke, or amend the person's registration under this chapter.
