Dear Representative Thompson:

On behalf of the Board of Firefighting Personnel Standards and Education (Board), I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25, because the Board has determined that the promulgation of the captioned rule may not be completed within one year after publication of the Notice of Intent to Adopt a Rule. The Board published its Notice of Intent to Adopt a Rule for LSA Document #11-730 on November 30, 2011, at DIN: 20111130-IR-655110730NIA. The rule is adding provisions to allow for the late submittal of recertification documentation, and the evaluation of the fiscal impact is taking an extended period of time, longer than the Board anticipated. In order to ensure that the fiscal impact is accurately evaluated, the Board expects that the rule will be approved by the Governor not later than June 30, 2013.

This notice setting forth the expected date of approval of LSA Document #11-730 as June 30, 2013, is being submitted in a timely manner. August 6, 2012, is the two hundred fiftieth day after publication of the Notice of Intent to Adopt a Rule.
