FOR: IEERB SHALL REPORT TO SUPERINTENDENT OF PUBLIC INSTRUCTION
TO ALL TO WHOM THESE PRESENTS MAY COME, GREETINGS:
WHEREAS, Indiana has recently enacted comprehensive collective bargaining reform for public education employees under Public Law 48-2011; and
WHEREAS, This legislation has substantially limited the nature and relationship of collective bargaining contracts to wages and wage related benefits; and
WHEREAS, Indiana school corporation contracts shall not exceed two years in duration and cannot force a school corporation to deficit spend; and
WHEREAS, The Indiana Education Employment Relations Board is charged with the regulatory authority over the implementation of this new law; and
WHEREAS, The Indiana Education Employment Relations Board consists of a chairperson, two board members, and limited staff to implement this comprehensive reform effort; and
WHEREAS, The Indiana Department of Education has extensive legal, regulatory, and policy staff available to directly support Indiana Education Employment Relations Board in the implementation of this landmark legislation; and
WHEREAS, The State Superintendent of Public Instruction is charged with the general supervision of public education and is the designated director of the Indiana Department of Education; and
WHEREAS, The Indiana Department of Education has extensive new legal and fiscal responsibilities related to the proper implementation of collective bargaining reform that can be more effectively and efficiently utilized with the direct oversight and leadership of the Indiana Education Employment Relations Board by the State Superintendent of Public Instruction.
NOW, THEREFORE, I, Mitchell E. Daniels, Jr., virtue of the authority vested in me as Governor of the State of Indiana, do hereby order that:
1. In furtherance of the goal of implementing the collective bargaining reform legislation, the three members of the Indiana Education Employment Relations Board who are appointed by and serves at the pleasure of the Governor, shall report to the Superintendent of Public Instructions and administer the agency in compliance with such policies and procedures as may be established by the Superintendent.
2. This Executive Order shall expire upon the enactment of legislation by the General Assembly to codify the measures described in this Executive Order.
