Interpretation of State Fire Marshal
and Building Law Compliance Officer

Title: Interpretation of 675 IAC 22-2.4-23, Section 2206.2.3(2)1

Purpose: This interpretation is a revision of the nonrule policy document interpretation published in the Indiana Register on 12/31/2009 and is intended to assist design professionals, contractors, and building owners by providing a clarification of the intent and meaning of the identified portion of Section 2206.2.3 of the 2008 Indiana Fire Code in order to protect the safety of the public and firefighters.

Interpretation: The State Fire Marshal interprets the below clause of Section 2206.2.3 of the 2008 Indiana Fire Code as follows:

Subdivision (2), Clause 1. INSTALLATION OF TANKS.

"Tanks shall be installed in accordance with Chapter 34 and shall be installed in special enclosures constructed in accordance with Section 2206.2.4 or in listed and approved tank enclosures or materials providing fire protection of not less than two (2) hours."

This clause requires that all tanks containing Class I flammable liquids to which this subdivision applies shall be listed in accordance with UL 2085. Chapter 34 requires the use of UL 2085 tanks for the types of hazards to the public and firefighters posed by the aboveground storage of flammable liquids. The reference to Chapter 34 in the text clause is intended to ensure that aboveground tanks used for storage of flammable liquids for, among other purposes, fuel dispensing are constructed to protect the safety of the public and firefighters. That requirement is more restrictive than the phrase "materials providing fire protection of not less than two (2) hours". It also contains the more specific requirement.

Under 675 IAC 12-4-8, "[w]here, in any specific case, different sections of the rules of the Commission specify different materials, methods of construction or other requirements, the most restrictive shall govern. Where there is a conflict between a general requirement and a specific requirement, the specific requirement shall be applicable.".
