Emergency Rule

Temporarily adds rules concerning scratch-off game number 0278. Statutory authority:
IC 4-30-3-9. Effective March 29, 2011.
SECTION 1. The name of the scratch-off game number 0278 is "Muscle Car Money™".
SECTION 2. Tickets in scratch-off game number 0278 shall sell for five dollars ($5) per ticket, unless otherwise adjusted by temporary price reductions or other promotional activities conducted or authorized by the commission.
SECTION 3. (a) Each ticket in scratch-off game number 0278 shall contain a total of twenty-five (25) play symbols and a total of twenty (20) prize symbols under a scratch-off material covering the game play data area.
(b) Each play symbol includes a caption that corresponds with and verifies the play symbol as follows:

(d) If a question arises as to a play or prize symbol, the caption that corresponds with the play or prize symbol will be used for final clarification.
(e) The game play data area of each ticket in scratch-off game number 0278 shall be divided into two (2) distinct game areas as follows:
(1) A game area labeled "YOUR NUMBERS" that contains twenty (20) play symbols and twenty (20) prize symbols with each play symbol appearing above and corresponding with a prize symbol.
(2) A game area labeled "WINNING NUMBERS" that contains five (5) play symbols.
SECTION 4. The:
(1) retailer validation code;
(2) game/pack/ticket number; and
(3) validation number;
are for commission or retailer use only and cannot be used or played as a play or prize symbol to win a prize.
SECTION 5. (a) A ticket in scratch-off game number 0278 must be validly purchased and the scratch-off material covering the game play data area must be fully removed in order to win a prize.
(b) If any of the play symbols in the area labeled "YOUR NUMBERS" match any of the play symbols in the area labeled "WINNING NUMBERS", the ticket may be redeemed for a prize in the amount represented by the prize symbol located below and corresponding with the matching play symbol.
(c) If the "
" (WIN) symbol is revealed, the ticket may be redeemed for a prize in the amount represented by the prize symbol located below and corresponding with the "" (WIN) play symbol.
(d) If the "
" (CAR) symbol is revealed, the ticket may be redeemed for a Muscle Car prize further defined in SECTION 6 of this rule [document].
SECTION 6. (a) Muscle Car prize winner will select one (1) of the following vehicles:
(1) 2011 Ford Mustang GT Premium Coupe;
(2) 2011 Chevrolet® Camaro Coupe 2SS; or
(3) 2011 Dodge Challenger R/T HEMI® Classic RWD.
Muscle Car prize winner may choose vehicle color from available manufacturer options.
(b) Muscle Car prizes include standard manufacturer options. Additional options may be available at the sole discretion of the lottery.
(c) The commission will pay the following on the behalf of a Muscle Car prize winner:
(1) estimated federal and state income withholding taxes on the value of the prize;
(2) dealer fees;
(3) fees to register the vehicle; and
(4) title fees or other fees necessary to obtain a license plate for the vehicle.
All other costs, taxes, fees, and expenses associated with the acceptance and use of any element of a prize not paid by the commission, including all state and federal taxes in excess of those paid by the commission, are the sole responsibility of the winner.
(d) The Hoosier Lottery reserves the right to substitute a prize of equal value in the event the noncash prize cannot be acquired.
(e) Muscle Car prizes are redeemable for cash. The cash value of a Muscle Car prize is $38,355. Muscle Car prize winners will not receive the cash difference if a vehicle of lesser value is selected.
SECTION 7.
For the purposes of fulfilling the commission's duty to pay an obligation on behalf of the prize winner under IC 4-30-11-11, Muscle Car prizes or other noncash prizes may be converted to cash, based on the estimated retail value of the prize. The cash balance remaining after payment of all applicable debts and taxes, if any, shall be paid to the prize winner.
SECTION 8. (a) The approximate number of possible prizes and the estimated odds for each prize level are as follows:
Total value of all prizes*: $12,186,120
Approximate print quantity: 3,600,000 (-3%/+1%)
(b) The approximate number of prizes and the estimated odds provided in subsection (a) are calculated based on an approximate print quantity. The actual quantity of tickets will vary from the approximate print quantity of tickets within a range of minus three percent (-3%) to plus one percent (+1%). The actual number of prizes and the odds for each prize amount will vary depending on the actual quantity of tickets.
(c) Prizes totalling two hundred twenty-four thousand forty dollars ($224,040) are to be awarded through the Hoosier Lottery's Muscle Car Money™ Second Chance Promotion. The value of the second chance prizes are included in the total value of prizes in subsection (a), but are not reflected in the odds calculations.
(d) If the print quantity is changed during production of this game or due to subsequent reorders of the game, the ratio of prizes and the total value of all prizes to the print quantity will be proportionately maintained so that the overall odds and prize payout percentage will approximate the values provided in subsection (a).
SECTION 9. The Muscle Car Money Second Chance Promotion Rules adopted by Hoosier Lottery on March 11, 2011, is hereby incorporated by reference and shall govern the conduct of the Hoosier Lottery Muscle Car Money Second Chance promotion. The incorporated document is available for public view at www.hoosierlottery.com. A copy of the rules may be obtained at Hoosier Lottery headquarters at 1302 N. Meridian St., Indianapolis, Indiana 46202.
SECTION 10. This document expires sixty (60) days after the last claim date established by the director for scratch-off game number 0278.
