Emergency Rule

Temporarily adds rules concerning scratch-off game number 0262. Statutory authority:
IC 4-30-3-9. Effective December 21, 2010.
SECTION 1. The name of scratch-off game number 0262 is "Indiana's $5 Million Club".
SECTION 2. Tickets in scratch-off game number 0262 shall sell for twenty dollars ($20) per ticket, unless otherwise adjusted by temporary price reductions or other promotional activities conducted or authorized by the commission.
SECTION 3. (a) Each ticket in scratch-off game number 0262 shall contain a total of thirty-four (34) play symbols and twenty-five (25) prize symbols located under a scratch-off material covering in the game play data area.
(b) Each play symbol includes a caption that corresponds with and verifies the play symbol as follows:

(d) If a question arises as to a play or prize symbol, the caption that corresponds with the play or prize symbol will be used for final clarification.
(e) The game play data area of each ticket in scratch-off game number 0262 shall be divided into three (3) distinct game areas as follows:
(1) An area labeled "WINNING NUMBERS" that contains eight (8) play symbols.
(2) An area labeled "YOUR NUMBERS" that contains twenty-five (25) play symbols and twenty-five (25) prize symbols with each play symbol above and corresponding to a prize symbol.
(3) An area labeled "BONUS $100" that contains one (1) play symbol.
SECTION 4. The:
(1) retailer validation code;
(2) game/pack/ticket number; and
(3) validation number;
that appears [sic, appear] on each ticket in scratch-off game number 0262 are for commission or retailer use only and cannot be used or played as a play or prize symbol to win a prize.
SECTION 5. (a) To play a ticket in scratch-off game number 0262, the ticket must be validly purchased and the scratch-off material covering the game play data area must be fully removed.
(b) If the "
" (GOLD BARS) play symbol is revealed in the area labeled "BONUS $100", the ticket may be redeemed for a prize of one hundred dollars ($100).
(c) If any of the play symbols in the area labeled "YOUR NUMBERS" matches a play symbol in the area labeled "WINNING NUMBERS", the ticket may be redeemed for a prize in the amount represented by the prize symbol that is located below and that corresponds with the matching play symbol.
(d) If the "
" (FIVE TIMES) play symbol is revealed in the area labeled "YOUR NUMBERS", the ticket may be redeemed for a prize five (5) times the amount represented by the prize symbol located below and corresponding with the play symbol.
(e) If the "
" (TEN TIMES) play symbol is revealed in the area labeled "YOUR NUMBERS", the ticket may be redeemed for a prize ten (10) times the amount represented by the prize symbol located below and corresponding with the play symbol.
SECTION 6. (a) The approximate number of possible prizes and the estimated odds for each prize level are as follows:
Total value of all prizes*: $90,520,220
Approximate print quantity: 6,000,000 (-3%/+1%)
(b) The approximate number of prizes and estimated odds provided in subsection (a) are calculated based on an approximate print quantity. The actual quantity of tickets will vary from the approximate print quantity of tickets within a range of minus three percent (-3%) to plus one percent (+1%). The actual number of prizes and the odds for each prize amount will vary depending on the actual quantity of tickets.
(c) Five million forty-five thousand dollars ($5,045,000) in prizes to be awarded through the Hoosier Lottery's Indiana's $5 Million Club Second Chance Promotion. The value of the second chance prizes are included in the total value of prizes but are not reflected in odds calculations.
(d) If the print quantity is changed during production of this game or due to subsequent reorders of the game, the ratio of prizes and total value of all prizes to the print quantity will be proportionately maintained so that the overall odds and prize payout percentage will approximate the values provided in subsection (a).
SECTION 7. Each prize of one million dollars ($1,000,000) and five million dollars ($5,000,000) will be paid as an annuity over a period of time, which shall not exceed twenty (20) years. Claimant may elect to take a lump sum payment instead of the annuity at a value to be determined by the lottery at the time of claim.
SECTION 8. The Indiana's $5 Million Club Second Chance Promotion Rules adopted by Hoosier Lottery on December 14, 2010, is hereby incorporated by reference and shall govern the conduct of the Hoosier Lottery Indiana's $5 Million Club Second Chance promotion. The incorporated document is available for public view at www.hoosierlottery.com. A copy of the rules may be obtained at Hoosier Lottery headquarters.
SECTION 9.
Game 0262 will remain on sale until the director determines an end date for a scratch-off game under 65 IAC 7-1-5. Tickets in game 0262 may remain on sale even if all instant prizes of [sic] have been claimed. The game may also be closed prior to all prizes being awarded.
SECTION 10. This document expires sixty (60) days after the last claim date in scratch-off game 0262.
