Under IC 4-22-2-24, notice is hereby given that on January 13, 2011, at 1:00 p.m., at the Department of Natural Resources, Division of Reclamation Field Office, 14619 West State Road 48, Jasonville, Indiana, the Natural Resources Commission will hold a public hearing on proposed amendments to 312 IAC 25-1-10.5, 312 IAC 25-1-32.5, 312 IAC 25-1-48, 312 IAC 25-1-51.5, 312 IAC 25-1-75.1, 312 IAC 25-4-18, 312 IAC 25-4-23, 312 IAC 25-4-59, 312 IAC 25-4-64, 312 IAC 25-4-115.1, 312 IAC 25-4-122.1, 312 IAC 25-4-122.2, 312 IAC 25-4-122.3, 312 IAC 25-4-127, 312 IAC 25-5-7, 312 IAC 25-5-16, 312 IAC 25-6-59, 312 IAC 25-6-93, 312 IAC 25-6-94, 312 IAC 25-6-95, and 312 IAC 25-7-5 governing coal mining and reclamation operations.

IC 4-22-2-24(d)(3) Justification Statement: This rulemaking is a required program amendment mandated by federal regulation. The Department of Interior's Office of Surface Mining is the federal oversight authority for coal mining in the nation and is the oversight agency of the Division of Reclamation. 30 CFR, Part 732 provides the Office of Surface mining must notify states with a primacy program of any changes to the regulation associated with the Surface Mining Control and Reclamation Act. The state must then modify its regulatory program to remain consistent with all federal requirements. A state may either mirror the regulation's counterpart or propose equivalent language. All requirements or costs by the rule amendments on regulated entities under IC 4-22-2-24(d)(3) are reasonably necessary for the implementation of IC 14-34.
