IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
The proposed rule amendment will not impose requirements or costs on small businesses under
IC 4-22-2.1-5. The proposed rule amendment is a schedule of civil penalties, to now include violations to the Certification Rule
355 IAC 7, the Office of Indiana State Chemist may impose on persons that violate
IC 15-16-2, the Commercial Fertilizer Law, or rules adopted under that chapter. Those that violate are subject to
IC 15-16-2-49.5:
Violations; penalties
Sec. 49.5. (a) If a person violates this chapter or a rule adopted under this chapter, the state chemist may:
(1) warn, issue a citation to, or impose a civil penalty on the person; or
(2) deny, suspend, revoke, or amend the person's registration under this chapter.
