IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses

Estimated Average Annual Reporting, Record Keeping, and Other Administrative Costs Small Businesses Will Incur for Compliance:
$75 per year for an estimated time of six hours per year (1/2 hour per month) at a cost of $10 per hour and an annual breeder license fee of $15.

Justification Statement of Requirement or Cost:
The addition of exotic cervidae to the game breeder license will impose costs and administrative requirements on businesses that are not currently licensed game breeders. However, there is a state statutory requirement for the rule governing game breeder and exotic cervidae licenses. IC 14-22-20.5-2 requires cervidae livestock operations to have a game breeder license from the DNR. Therefore, changes to the rule governing the game breeder license are needed to incorporate these additional species of cervidae, including elk, red deer, fallow deer, and caribou.
There is an annual license fee of $15 for businesses and others that own exotic species of cervidae such as elk, red deer, moose, and caribou. The rule already includes administrative requirements for keeping an inventory, issuing proper receipts, and submitting an annual report. The businesses that own exotic cervidae have already been required to keep an inventory and comply with deer identification and disease testing requirements by the Indiana State Board of Animal Health in 345 IAC 2-7. Furthermore, some of the businesses that will be affected already own white-tailed deer and, therefore, already are paying the license fee and completing the administrative requirements each year.
The Indiana Deer and Elk Farmers Association has supported the DNR in adding exotic cervidae to the game breeder license. Not only is it required by law, these provisions will clarify the requirements for the possession and sale of exotic cervidae.

Regulatory Flexibility Analysis of Alternative Methods:
There are no known alternatives to the requirement of a breeder license for exotic cervidae since the state statute in IC 14-22-20.5 requires owners of these species to have one. The fee for this license is also established in IC 14-22-20-1 and cannot be changed by the DNR or Natural Resources Commission. The administrative requirements, including an annual report, have been required for many years for owners of white-tailed deer and other species in order to ensure that the animals were obtained lawfully and provide a record if a disease appears in one of these animals. The Indiana State Board of Animal Health already requires an inventory, animal identification, and other disease testing requirements in 345 IAC 2-7 for all species of cervidae (both native and exotic) in order to prevent the transmission of diseases such as bovine tuberculosis to other animals, both those in captivity and those in the wild.
