TITLE 315 OFFICE OF ENVIRONMENTAL ADJUDICATION

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Office of Environmental Adjudication intends to adopt a rule concerning the following:

OVERVIEW: Amends 315 IAC 1-1-2, which identifies provisions of the code of judicial conduct that are applicable to environmental law judges of the Office of Environmental Adjudication under IC 4-21.5-7-6(b)(3), to accommodate amendments received by the Indiana Supreme Court through October 15, 2008, and to allow environmental law judges to provide mediation services. Amends 315 IAC 1-2-1 concerning definitions. Amends 315 IAC 1-3-2 concerning procedures for correcting incomplete petitions for review. Amends 315 IAC 1-3-3 concerning the use of electronic mail. Amends 315 IAC 1-3-4 concerning page limits for briefs. Adds 315 IAC 1-3-4.1 concerning deadlines for filing responses. Adds 315 IAC 1-3-13.1 concerning the record of proceeding and transcripts. Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-5, specifically IC 5-28-17-5(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
