TITLE 65 STATE LOTTERY COMMISSION

DIGEST

Adds rules regarding the Hoosier Lottery Mega Millions game. Statutory authority: IC 4-30-3-9. Effective January 12, 2010.


SECTION 1. The name of this draw game is "Hoosier Lottery Mega Millions".

SECTION 2. "MUSL" means the Multi-State Lottery Association, a government-benefit association wholly owned and operated by member commissions, state agencies, and other political subdivisions, which are authorized to conduct lottery games.

SECTION 3. The Mega Millions Product Group Rules adopted by MUSL on December 15, 2009, and last amended on December 31, 2009, is hereby incorporated by reference and shall govern the conduct of the Hoosier Lottery Mega Millions game and Mega Millions promotion. The incorporated document is available for public view at www.hoosierlottery.com, and copies may be obtained by request mailed to the offices of the State Lottery Commission of Indiana at 201 South Capitol Ave., Suite 1100, Indianapolis, IN 46225.

SECTION 4. 65 IAC 5-2 and 65 IAC 5-3 apply to Hoosier Lottery Mega Millions to the extent that they do not conflict with this document and the Mega Millions Product Group Rules incorporated by reference in SECTION 3 of this document.

SECTION 5. All liability of:
(1) MUSL and its members, officers, directors, and employees; and
(2) the commission, the director, and the employees of the commission;
for any prize in Mega Millions terminates upon payment of the prize or upon the expiration of one hundred eighty (180) days after the date of the Mega Millions selection event in which the prize was won.

SECTION 6. A purchaser of a Hoosier Lottery Mega Millions ticket agrees to comply with and abide by all applicable Indiana laws, rules, regulations, procedures, and decisions of the Hoosier Lottery, and by directives and determinations of the executive director. The player shall also be bound to all applicable provisions in the Mega Millions Finance and Operations Procedures. Litigation, regarding any Hoosier Lottery Mega Millions ticket, shall only be maintained within Indiana. Nothing in this rule shall be construed as a waiver of any defense or claim the Hoosier Lottery may have in the event a player pursues litigation against the Hoosier Lottery, its officers, or employees. All decisions made by the Hoosier Lottery, including the declaration of prizes and the payment thereof and the interpretation of Mega Millions Rules, shall be final and binding on all purchasers and on every person making a claim in respect thereof, but only in the jurisdiction where the Mega Millions ticket was issued.
