Notice of Public Hearing
Under
IC 4-22-2-24, notice is hereby given that on January 28, 2010, at 10:00 a.m., at the Indiana Government Center South, 402 West Washington Street, Conference Center Room 17, Indianapolis, Indiana, the Fire Prevention and Building Safety Commission will hold a public hearing on a proposed rule to add
675 IAC 19-4, which adopts by reference and amends the American Society of Heating, Refrigerating and Air-Conditioning Engineers, Inc. Standard 90.1, 2007 Edition, as the Indiana Energy Conservation Code, 2009 Edition and repeals
675 IAC 19-3. Public comments are invited and may be directed to the Indiana Department of Homeland Security, Code Services Section, Attn: Mara Snyder, Indiana Government Center South, 302 West Washington Street, Room E243, Indianapolis, Indiana 46204.
The Fire Prevention and Building Safety Commission has authority to adopt this rule under
IC 22-13-2. This rule is an update of Indiana's Energy Conservation Code, and such update is required for compliance with the following federal laws:
(1) for compliance with the requirements for grants under the American Recovery and Renewal Act - Sec. 410(a)(2)(B);
(2) for compliance with 42 U.S.C. 6833(b) - requirement for states to adopt an updated energy conservation code; and
(3) 26 CFR 179D - tax deductions for energy efficient commercial buildings.
The Commission relied, in part, on data and an analysis of that data prepared by staff in determining that the imposition of the requirements or costs created by the rule are necessary. That data includes information on long-term cost savings associated with the use of the rule.
