Under IC 4-22-2-24, notice is hereby given that on January 5, 2010, at 9:30 a.m. EST, at the National City Center, 101 West Washington Street, Suite 220, Room 224, Indianapolis, Indiana, the Indiana Utility Regulatory Commission will hold a public hearing on a proposed rule (RM #09-01) to add 170 IAC 15 regarding landlords sub-billing for water and sewage disposal service.
The purposes of this rule are: (1) to define terms not fully explained by IC 8-1-2-1.2; (2) to clarify certain sub-billing areas not fully explained by IC 8-1-2-1.2(b) through IC 8-1-2-1.2(d); and (3) to clarify the procedure to file the complaints referenced in IC 8-1-2-1.2. One of the central purposes of the rule is to create a framework in which the Commission can uniformly and consistently address complaints that allege that a landlord has violated the provisions of the statute and is therefore a "public utility". Another is to provide clear direction with respect to the specific steps that must be followed to be considered to be exempt from regulation as a public utility under the statute. A secondary purpose is to provide direction to a landlord that has violated the provisions of the statute, regarding the steps that must be followed to be returned to exempt status upon a demonstration of compliance with the rule. This rule presents no cost either to landlords or to tenants. The only costs are those properly attributed to the underlying statute. It is useful as well to remember that compliance with the rule and the statute are completely voluntary.
