Dear Representative Pelath:
On behalf of the Medical Licensing Board of Indiana, I am submitting this letter to the Administrative Rules Oversight Committee in compliance with
IC 4-22-2-19 and
IC 4-22-2-25. The intent of this rulemaking action is to add definitions relating to anesthesia under
IC 25-27.5-5-4(f) and to implement P.L.90-2007 regarding requirements for prescriptive authority for qualified licensed physician assistants and to make nonsubstantive changes by updating rule language and clarifying the prescriptive authority requirements.
A public hearing approving the rule was held on September 24, 2009; however, as of this notice, the Office of Management and Budget has not completed their review of the fiscal analysis. For this reason, it is unlikely that the rule will be approved by the Governor within one year of the date of publication of the Notice of Intent to Adopt a Rule. The agency expects that the rules can be approved by the Governor by June 30, 2010.
This notice setting forth the expected date of approval of LSA Document Number 09-164 as June 30, 2010, is being submitted in a timely manner. November 9, 2009, is the two hundred fiftieth day after publication of the Notice of Intent to Adopt a Rule.
