Notice of Public Hearing
Under
IC 4-22-2-24, notice is hereby given that on November 2, 2009, at 2:00 p.m. EST, at the National City Center, 101 West Washington Street, Suite 220, Room 222, Indianapolis, Indiana, the Indiana Utility Regulatory Commission will hold a public hearing on a proposed rule (RM #08-01, LSA Document #09-190) to amend
170 IAC 5-3 regarding pipeline safety standards for transportation of gas, hazardous liquids, carbon dioxide fluids, and related pipeline facilities.
This amended rule increases safety requirements essential to reducing the risk of fires and explosions and the resulting property damage, injuries, and loss of human life; adds terms and provisions required by the recent amendment of
IC 8-1-22.5 to include Commission jurisdiction over hazardous liquids and carbon dioxide fluid by pipeline; adds more stringent reporting requirements so the Pipeline Safety Division of the Commission can accurately assess compliance with critical safety measures; removes redundant provisions already covered by existing law; and clarifies certain areas of the rule, including terms not fully explained by statute. These additional duties may create additional duties for utilities, which could cost the state industry as a whole up to $163,190 annually.
