TITLE 511 INDIANA STATE BOARD OF EDUCATION

Notice of Public Hearing
LSA Document #09-57

Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on October 9, 2009, at 9:00 a.m. EDT, at 151 West Ohio Street, Virgil Grissom Conference Room, Indianapolis, Indiana, the Indiana State Board of Education will hold a public hearing on proposed changes to 511 IAC 7.
The proposed rule amends 511 IAC 7 to establish the requirements and procedures when a parent revokes consent for special education services. The rule amends 511 IAC 7 to reflect that a parent's written revocation of consent for special education services terminates the student's classification as a student with a disability, eliminates an evaluation, and treats a subsequent parental request for evaluation as an initial evaluation. The proposed rule requires the discontinuation of special education services on the eleventh instructional day after notice when the parent revokes consent and reflects that any party to a due process hearing has the right to be represented by an individual who is not an attorney. Effective 30 days after filing with the Publisher.
Copies of these rules are now on file at the Indiana Department of Education, 151 West Ohio Street, and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
