TITLE 876 INDIANA REAL ESTATE COMMISSION

Under IC 4-22-2-23, the Indiana Real Estate Commission intends to adopt a rule concerning the following:

OVERVIEW: Amends 876 IAC 3-2-4 and adds 876 IAC 3-3-2.5 to comply with IC 25-34.1-8-10(b) and IC 25-34.1-8-10(c) to provide that the Real Estate Appraiser Licensure and Certification Board establishes the criminal history background check requirements for appraiser licensure or certification. Requires that applicants for licensure or certification submit fingerprints for a national criminal history background check. The board may utilize information contained in an applicant's criminal history background check in refusing to issue a license or certificate or in a determination to issue a probationary license or certification under IC 25-1-11-19. Provides for the submission of fingerprints for a national criminal history background check by applicants for renewal of an appraiser license or certification and the reinstatement of an expired appraiser licensure or certification. The board may utilize information contained in an applicant's criminal history background check in making their renewal or reinstatement decision under IC 25-1-6-4 or IC 25-1-8-8.
