IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Description of the Rule
The proposed rule expands the list of immunizations required for attendance at public schools to include those recommended by the Centers for Disease Control and Prevention (CDC). The rule also further defines school reporting requirements to require electronic reporting via the immunization data registry.
Immunization recommendations are updated regularly by the CDC based on currently available vaccine, new scientific data in support of vaccine use, and the epidemiology of vaccine preventable disease activity. The rule has not been updated since its original adoption in 1976 and is outdated based on new evidence and recommendations. Advances in technology have also changed the immunization reporting mechanisms available to the ISDH and public schools.

Economic Impact on Small Businesses
1. Estimate of the number of small businesses, classified by industry sector, that will be subject to the proposed rule:
IC 4-22-2.1-4 defines a small business as any person, firm, corporation, limited liability company, partnership, or association that:
(1) is actively engaged in business in Indiana and maintains its principal place of business in Indiana;
(2) is independently owned and operated;
(3) employs one hundred (100) or fewer full-time employees; and
(4) has gross annual receipts of five million dollars ($5,000,000) or less.
This rule has an impact on children required to be immunized and public schools required to report immunization data to the ISDH and does not impact small businesses as defined by IC 4-22-2.1-4.

2. Estimate of the average annual reporting, record keeping, and other administrative costs that small businesses will incur to comply with the proposed rule:
