Under IC 4-22-2-24, notice is hereby given that on July 21, 2009, at 10:30 a.m., at the Indiana Government Center South, 302 West Washington Street, Room E114, Indianapolis, Indiana, the Alcohol and Tobacco Commission will hold a public hearing on a proposed new rule to amend 905 IAC 1-12.5 concerning server training as required by IC 7.1-3-1.5-16.
IC 7.1-3-1.5 mandates the Alcohol and Tobacco Commission to approve server training programs that are designed to educate alcohol servers on the selling, serving, and consumption of alcoholic beverages. Specifically, the Alcohol and Tobacco Commission shall (i) issue trainer certificates to individuals to conduct server training; (ii) approve a trainer program by a third party; (iii) establish a server program; (iv) approve a server program by a third party; (v) issue trainer certificates; and (vi) issue server certificates. A trainer program is designed to educate individuals on the training of alcohol servers on the selling, serving, and consumption of alcoholic beverages. A server program is designed to educate alcohol servers on the selling, serving, and consumption of alcoholic beverages. The proposed rule imposes no costs on businesses. The only mandatory cost is borne by the individuals desiring to seek employment as alcoholic beverage servers. Businesses have the option of (i) requiring servers obtain training prior to employment; (ii) engaging an outside provider to conduct server training for employees; or (iii) conducting server training on the premises for employees.
Copies of these rules are now on file at the Indiana Government Center South, 302 West Washington Street, Room E114 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
