Under IC 4-22-2-24, notice is hereby given that on June 25, 2009, at 10:00 a.m., at the Department of Insurance, 311 West Washington Street, Suite 300, Indianapolis, Indiana, the Department of Insurance will hold a public hearing on proposed rules regarding definitions, benefit standards for standardized Medicare supplement benefit plans, supplement benefit plan policies or certificates, required disclosure provisions, the prohibition against use of genetic information and requests for genetic testing, and to otherwise bring the rule in conformity with Title XVIII of the federal Social Security Act (42 U.S.C. 1395 et seq.).

The proposed rule amends 760 IAC 3 to conform Indiana's rules to federal law. State insurance departments are directed to amend their Medicare supplement rules to conform to the new federal program. The amendments will represent a change in the types of Medicare supplement policies that may be sold by insurers. The rule also prohibits issuers of Medicare supplement policies from discriminating against individuals on the basis of genetic information and prohibits certain uses of genetic information and testing. State rules governing Medicare Supplement policies are based on a model regulation adopted by the National Association of Insurance Commissioners (NAIC). States must adopt the NAIC model revisions in order to continue to regulate the Medicare Supplement market. The department determined that adoption of the NAIC model regulation would be proper in order to acknowledge the recent changes in federal law.
